과학수사 증거물로서 국내에서 시행되고 있는 DNA 법규는 강력범죄 예방 및 수사의 효율성, 인권 보호 등 관점에서 관리되어야 한다. DNA 법규를 운영하는 주요 국가들 중 영국과 미국에서는 기술진보 등에 따른 DNA 법규개정 및 특별법 제정 등을 통하여 이러한 여러 가지 가치를 수용하고 있다. 국내에서 DNA 법규에 대한 관심은 여러 헌법소원 건을 통하여 확인할 수 있는데 우리 DNA 법규또한 시대 발전에 부응하고 기술 발전을 수용하면서도 인권보호에 소홀함이 없도록 개정하여야 한다. 특히, 현재 이원화된 DNA 관리체계를 일원화하고 DNA 수사기법의 현실적인 사항 등을 반영하여 법규 개정이 필요하다. 미제사건에 관련된 DNA 시료 관리 및 DNA 표현형 분석 등에 대한 사항을 적절히 수용하여야 한다. 그 뿐만 아니라, DNA 과학 수사기술의 발전사항을 인권보호와 조화롭게 DNA 법규에 수렴시킴으로써 DNA 수사의 과학성과 효율성을 법규에 반영하여 지속적으로 개선 발전시켜야할 것이다.
Abstract
DNA legislation, which is conducted in Korea as evidence of scientific investigation, should be managed in terms of prevention of violent crime, efficiency of investigation, and protection of human rights. DNA legislation in the United Kingdom and the U.S.A., which can be considered advanced nations in DNA management, these values are accepted by revising DNA laws and establishing special laws. In Korea, interest in DNA legislation can be confirmed through various constitutional complaints. Our DNA laws should also be amended to meet the development of the times and accept the technological advancement, but not to neglect the protection of human rights. In particular, it is necessary to revise the legislation by unifying the DNA management system that is now dualized and reflecting realistic issues of DNA investigation techniques. DNA sample management and DNA phenotype analysis related to the cold case should be properly accommodated. In addition, it is necessary to continually improve the science and efficiency of DNA investigation by integrating the advances of DNA science technology into the DNA regulations and convergence with the protection of human rights and harmony with DNA regulations.
