Abstract

Although many automobile collisions cause only minimal property damage, claims for bodily injury—seeking medical expenses and non-pecuniary damages—are frequently filed. This raises a central issue of causation between the accident and the alleged injury and, in turn, reflects moral hazard that can manifest as a broader social pathology. Such patterns both leak insurance funds and enable strategic misuse of the insurance system. This study therefore aims to establish normative criteria for causation assessment and for curbing excessive claims in the context of minor loss under motor insurance, and to propose a procedural and evidentiary framework for practical application. Because no general statutory definition of “minor accident” currently exists in Korean law, practice relies on standard policy terms and industry guidelines. Building on comparative analysis, the paper advances a two-track design and related legislative suggestions. First, the assessment of minority in property loss should proceed on qualitative grounds: a case qualifies as minor where exterior, localized damage can be restored to original condition without parts replacement, and where there is no damage to the vehicle’s structural members, energy-absorbing components, or detection/safety sensors. By contrast, panel deformation requiring panel-beating or welding, structural damage, misalignment of openings, or suspension/steering alignment out of tolerance excludes the case from the minor category. Second, where a case is thus classified as minor in property terms, bodily injury claims should be subjected to a rebuttable procedural presumption that the probability of serious injury is generally low. That presumption can be overcome by showing immediacy(prompt medical attendance and contemporaneous records), consistency(temporal and substantive coherence of complaints and treatment), objective indicators(imaging and medical records, event-data recorder outputs, alignment reports), and individual vulnerability(e.g., pre-existing conditions, age, pregnancy, occupational factors). Third, in borderline cases, the legitimacy of limited tear down/inspection should be judged by circumstances at the time of the accident; however, in clearly minor cases the shifting of expert-inspection costs should be restricted. Fourth, to reduce variation in the field, the paper proposes a standardized evidence package— comprising photographs, repair statements, alignment measurements, and event-data recorder summaries—together with stage-specific checklists for investigation and adjudication. The proposed framework is expected to contribute to moral-hazard mitigation, litigation and adjustment cost reduction, alleviation of regressive premium shifting, and restoration of proportionality in compensation. Given medical uncertainty and data-access constraints, phased implementation with pilot programs, joint guidelines, and a case database, accompanied by policy evaluation, is recommended.
