경찰 신상정보등록대상자 관리의 문제점과 개선방안 연구 : 법제도상 문제를 중심으로

신상정보등록제도는 신상정보등록대상자에게 본인의 신상정보가 국가기관에 등록되어 있다는 사실을 인식시키고, 그들의 신상정보를 일반 국민에게 알려 성범죄를 예방하는 데 목적이 있다. 이러한 목적을 달성하기 위해서는 무엇보다 등록된 신상정보의 정확성이 중요하다. 따라서 등록대상자로부터 신상정보를 접수하고, 그 진위를 확인하는 ‘경찰 신상정보등록대상자 관리’는 이 제도의 핵심이라고 할 수 있다. 그런데 현행 신상정보등록대상자 관리는 법 제도상 몇 가지 문제점을 안고 있다. 첫째, 차량 정보 등록기준이 합리적이지 못하다. 둘째, 신상정보 제출서 진위확인이 부실하다. 셋째, 신상정보등록대상자 점검의 실효성이 부족하다. 제기된 문제의 해결방안은 다음과 같다. 첫째, 차량 정보 등록기준을 변경하여 명의 외에도 ‘실제 운행 여부’를 등록기준에 포함하도록 하여, 누락되는 차량이 없도록 해야 한다. 둘째, 신상정보 접수 시 관할 경찰관서의 장으로 하여금 실제거주지를 직접 확인하도록 하여 실제거주지 정보의 정확성을 담보해야 한다. 셋째, 신상정보등록대상자에게 등록정보 진위확인을 위한 점검 수인의무를 부과하여, 점검의 실효성을 확보해야 한다.
Abstract
The sex offenders' personal information registration system aims to prevent sex crimes by recognizing that their personal information is registered in a national institution and informing the general public of their personal information. In order to achieve this purpose, the accuracy of registered personal information is important. Therefore, the core of this system is the "management of sexual crime personal information registered by the police" that receives personal information from registered persons and checks the authenticity of it. However, the current management of sex offenders' personal information registration has several problems under the legal system. First, the vehicle information registration standard is not reasonable. Second, the authenticity of the submission of personal information is poor. Third, the effectiveness of checking the person subject to personal information registration is insufficient. The solution to the problem raised is as follows. First, it is necessary to include 'actual operation' in the vehicle information registration standard so that there are no missing vehicles. Second, when receiving personal information, the head of the competent police station should directly check the actual residence. Third, the person subject to personal information registration shall be obligated to accept inspection to confirm the authenticity of registered information.
