Abstract
Online platforms are growing rapidly, such growth spurred by the development of ICT technology. At an early stage, such platforms were expected to increase competition and benefit consumers due to their low marginal costs and low entry barriers, compared to traditional businesses. However, there has since been a substantial change of view as online platform businesses are increasingly growing into global big tech giants that monopolize the market and wield significant influence on the national economy as well as having social and political implications. As such, as with other jurisdictions, there have been discussions of regulating large online platform operators in Korea. Korean regulatory agencies and legislators have proposed various bills currently pending at the National Assembly to enhance fairness and transparency of online intermediation services and to protect online platform users. As a sector-specific regulation, the National Assembly passed a partial amendment to the Telecommunications Business Act imposing certain obligations on app-market service providers such as Google and Apple. On a broader level, an amendment to Korea’s business combination rules was passed to more scrutinize merger filings. In addition, the Korea Fair Trade Commission, the competition authority in Korea, has proposed a guideline to restrict abusive behaviors of online platform service providers, which is controversial. Such discussions in Korea have been greatly influenced by the ongoing discussions on online platform regulations in the EU and U.S. However, foreign examples should be viewed in the context of the specific jurisdiction and it is important to sufficiently understand the background of foreign legislations and comprehensively compare and analyze foreign markets before drawing implications to the domestic market. In particular, it is worth noting that current and pending EU regulations may result in targeting U.S. big tech giants and actually bring competitive benefits to European companies given that there are not may European online platform businesses with global presence. whereas in Korea, it would be important to find a balance between innovation and regulation as many domestic online platform businesses have been showing successful growth, some even expanding their business globally. That said, it appears that the recent bill proposals regulating online intermediation services generally lack such comprehensive review and, as a result, are not sufficiently supported with empirical market analysis. Such empirical analysis is a key step in introducing economic regulations and forms grounds for justification of a certain regulation. Considering the significance of online platforms and their innovative aspects in contemporary market economy, it is imperative that such online platform regulations be introduced on a step-by-step approach and on an as-need basis, based on such empirical market studies. Policy-makers should also consider flexible forms of regulations, as opposed to general regulations that are unilaterally applicable to online platform businesses, to better accommodate new services and business models. Lastly, to avoid duplicate regulations, the scope of new regulations must be limited to the areas that are not covered by existing legislation. Such duplicity often occurs due to the inefficiency between agencies – mainly, the competition authority and sector-specific regulatory agencies, and may be avoided by a clear delineation of their roles and responsibilities and mandating cooperation between relevant agencies.
