Abstract
In the Korean market, which shows a high global penetration rate for e-commerce, the influence of online platforms is becoming even stronger, and the dependence of both consumers and small businesses on it is increasing. Online platforms are causing various issues in the market, including ‘the power imbalance problem’ where unfair trading practices arise due to the platforms' superior position over their partner businesses, and ‘the monopoly problem’ where market competition is restricted due to platform monopolization, leading to decreased consumer welfare and stifled innovation. To address these issues, major countries such as the EU, Germany, the UK, and Japan have enacted regulations on online platforms. In South Korea, the 21st and 22nd National Assemblies have proposed several bills, those are ‘the Online Platform Transaction Fairness Act (Draft)’ and ‘the Online Platform Monopoly Regulation Act (Draft)’. However, those bills have not yet been passed. The reason is that for the former, the government has decided to apply self-regulation based on its policies. As for the latter, there are concerns that directly adopting the strong regulatory measures, such as the pre-designation approach adopted by the EU, might fundamentally block the growth potential of domestic platforms. Firstly, as evidenced by incidents such as the Coupang case, the unilateral fee increase by Baedal Minjok, and the Timon and Wemakeprice cases, there are certain limitations in regulating the power imbalance between online platforms and their partner businesses through self-regulation policies. Therefore, it is necessary to establish ‘the Online Platform Transaction Fairness Act’ to ensure that transactions between platforms and their partner businesses are conducted fairly. Next, monopolistic platforms rapidly dominate the market through network effects and tipping effect. In this situation, the existing competition law system, which relies on ex-post intervention, often takes too long for investigation and sanctions, making it difficult to restore competition and innovation in a timely manner. To achieve effective regulation in this regard, it is necessary to enact ‘the Online Platform Monopoly Regulation Act’ which involves pre-designating the platforms. However, for platforms pre-designated as subjects of regulation, the burden of proof for legality shifts, and after designation, they face significant constraints on their actions, such as limitations on aggressive marketing. Therefore, it is necessary to strengthen the pre-designation criteria and ensure that the competition authorities narrow the scope of regulation and are very cautious in making designations.
