2022년 6월 제12차 WTO 각료회의에서 채택된 수산보조금협정을 시행하는 과정에서 제기될 수 있는이슈들을 통상법적 측면에서 분석하였다. 먼저 수산보조협정의 협상과정을 살펴본 뒤에 협정의 적용범위와 정의, IUU 행위에 기여하는 보조금과 남획에 기여하는 보조금 등의 금지보조금 및 허용보조금을 중심으로 살펴보았다. 특히 불법⋅미신고⋅미규제에 기여하는 보조금과 남획에 기여하는 보조금의 성격과 발동요건을 비교 분석하였다. 다음으로 수산보조금협정을 WTO 보조금협정과 비교하였다. 구체적으로는 수산보조금협정상 금지보조금으로 분류하는 근거를 보조금협정과 연계하는 조항의필요성, 특정성을 수산보조금에 적용시 제기될 수 있는 이슈들 및 협정 위반시 적용가능한 조치의근거 필요성을 제시하였다. 끝으로 향후 추가로 진행될 수산보조금협상에서 제기될 주요 이슈로적절하고 효과적인 개도국조항을 위한 방안 발굴시 활용가능한 WTO 분쟁사례들을 제시하였고 또한FTA에서의 수산보조금 협상을 위한 방향을 제시하였다.
Abstract
This paper analyzes the WTO Agreement on Fisheries Subsidies (“the Agreement”) which was agreed at the twelfth Ministerial Conference in June 2022. First, after a brief review of the negotiations, we examine key features of the Agreement such as provisions on scope, prohibited subsidies, special and differential treatment with attaching importance to the IUU subsidies and overfishing subsidies. Next, we analyze the Agreement mainly in comparison with the WTO SCM Agreement. In particular, our analyses focus on the linkage between the Agreement and the WTO SCM Agreement, how to apply the existing rules to the new Agreement, and the types of measures applicable in the event of violation of the Agreement. Finally, we conclude with future issues such as the adequate and effective special and differential treatment and the FTA fisheries negotiations.
