Abstract
The recently released draft text of the TPP includes a “catch all” provision in the fisheries subsidies part. This provision basically prohibits TPP countries' subsidy programs that support fishing activities targeting fish stocks in an overfished condition. This is in fact the resurrection of a similar provision being discussed in the context of the WTO DDA fisheries subsidies negotiations as can be found in the 2007 Proposed Text of the Rules Negotiation Chair. As the suggested “catch all” provision included in the TPP draft text apparently contains ambiguous terms and indeterminate conditions that have been criticized in the DDA fisheries subsidies negotiations, it is imperative that this provision be further clarified and fine-tuned during the final stage of the TPP negotiations in 2014. As the provision currently stands, depending upon the fish stocks and governments at issue, it can apply to a wide range of governmental programs and designate them as prohibited subsidies. Considering the extremely broad nature of the provision, sufficient attention and discussions should be ensured so as to guarantee that this provision can properly operate in practice, both legally and scientifically. From the perspective of legal issues, the present “catch all” provision in the TPP arguably constitutes a significant departure from the basic principles and architecture of the SCM Agreement such that it is not entirely clear whether and how it can operate in actual disputes and dispute settlement proceedings. With this in mind, the terms and conditions of the provision should be formulated in a way that are compatible with and verifiable by the current methodology of marine science. Only a properly designed fisheries subsidies norms and a catch all provision will be able to deter the deteriorating conditions of the global fish stocks. This paper aims to provide new ideas and suggestions to fill the loopholes in the suggested catch all provision in the TPP text and, ultimately, to attain the crucial goal of protecting depleting global fish stocks.
