제11차 각료회의 이후 WTO 수산보조금 협상 동향과 전망 -CPTPP와 USMCA의 수산보조금 비교 연구를 중심으로-

초록

국제사회는 수산자원 고갈과 어업의 지속가능성을 저해하는 주요 원인으로 수산보조금을 지목하고, 이를 규율하기 위한 국제규범 정립을 본격화하고 있다. 특히, WTO 수산보조금 협상에서 시작된 수산보조금 규율은 양자간 FTA 협정에 우선 채택되면서 규율이 확산되고 있다. 포괄적·점진적 환태평양경제동반자협정(CPTPP)와 미국·멕시코·캐나다 협정(USMCA)가 대표적이다. 이들 회원국이 타국과 체결한 FTA의 재협상을 통해 수산보조금 규율을 추가할 가능성을 고려해보면, 수산보조금 규율의 확산 가능성은 더욱 커졌다고 할 수 있다. WTO 제12차 각료회의에서 의미있는 성과 도출이 예견되었던 수산보조금 협상이 코로나 사태로 또다시 연기되면서, WTO 수산보조금 협상은 CPTPP, USMCA의 영향을 받을 수밖에 없게 되었다. CPTPP와 USMCA가 2018년과 2020년에 각각 회원국의 국내 비준을 거쳐 공식 발효되었기 때문에 이들 국가들의 WTO 수산보조금 협상에서의 입장도 변화될 것으로 예견되기 때문이다. 이에 본 논문에서는 제11차 각료회의 이후의 WTO 수산보조금 협상 동향을 살펴보고자 한다. 그리고 CPTPP 및 USMCA 상의 수산보조금 관련 조항을 비교‧분석함으로써 향후 WTO 수산보조금 협상에 대한 전망하고 향후 협상 전략에 관해 제언하고자 한다.

Abstract

The international community has pointed out fisheries subsidies as the main cause of depletion of fisheries resources and impeding the sustainability of fisheries and is in full swing establishing international norms to regulate them. In particular, there is a tendency that the fisheries subsidies rules, which started in the WTO fisheries subsidies negotiations, is first adopted in the Regional Trade Agreement, through which related rules are spreading. The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) and the US-Mexico-Canada Agreement (USMCA) are representative. Considering the possibility that these member states will add rules for fisheries subsidies through renegotiation of FTAs ​​concluded with other countries, it can be said that the possibility of the spread of fisheries subsidies rules has increased. As the fisheries subsidies negotiations, which were predicted to draw meaningful results at the WTO 12th Ministerial Conference, were postponed again due to the recent COVID-19 crisis, the WTO fisheries subsidies negotiations will inevitably be affected by the CPTPP and USMCA. This is because CPTPP and USMCA were officially entered into force in 2018 and 2020 after domestic ratification by member states, respectively, so it is expected that these countries' positions in the WTO fisheries subsidies negotiations will also change. In this paper, the trend of WTO fisheries subsidies negotiations after the 11th Ministerial Conference is examined. In addition, by comparing and analyzing the provisions related to fishery subsidies in the CPTPP and USMCA, this study intends to forecast future WTO fisheries subsidies negotiations and to suggest future negotiation strategies.
