Abstract

This paper addresses the limitations of previous studies that have focused on Hegel’s theory of the right of necessity (Notrecht) solely as a justification theory, while neglecting instances where Hegel approached the issue outside this framework. Starting from the need to integrate these two perspectives, the paper analyzes both the justificatory arguments articulated in the Grundlinien der Philosophie des Rechts and the negation of necessity expressed in Hegel’s 1817/19 lecture notes. It then examines the functional demands and transformative tasks of contemporary legal theory as discussed by Niklas Luhmann and Günther Teubner, showing that Hegel’s reflections on necessity resonate strongly with their concerns. On this basis, the paper argues that Hegel’s theory of necessity can be interpreted as an anticipatory model of reflexive legal theory and suggests that such a reading opens the possibility of extending his insights into current debates on human rights and basic rights.
