Abstract

The purpose of this paper is to closely analyze Hegel’s contract theory which was founded in the ‘contract’ section of Hegel’s Philosophy of Law, and based on this, to clarify the relationship between his contract theory and the liberalistic theories of natural law. To this end, I first explained the characteristics of Hegel’s contract theory through an analysis of the general nature of the contract and its components, and then analyzed the similarities and differences of Hegel’s contract theory with the liberalistic theories of natural law. First, in considering the general nature of the contract, I explained the contradiction inherent in the concept of the contract, where its nature was defined as ‘the mediation of an identical will within the absolute distinction between owners of property who have being for themselves.’ Second, I defined the essence of the contract more strictly through an analysis of its components. There are three components of the contract. The first component is ‘the arbitrary will’, the initial condition for contract establishment. The second component is ‘the common will as the identical will posited by the contracting parties’, the essential condition for contract establishment. And the third component is the individual external ‘thing’ that is the object of the contract. The three components of the contract have the following implications. ‘The arbitrary will’ means freedom of choice of free and equal persons, ‘the common will’ appears to be legal binding power through an external form of the contract, stipulation, and the forms of the ethical life such as marriage or the state are excluded from ‘the object of the contract.’ Third, based on the above discussion, I explained the relationship of hegel’s contract theory and the liberalistic theories of natural law by analyzing their similarities and differences. Hegel’s contract theory has something in common with the liberalistic theories of natural law in that it actively recognizes the freedom of persons and their equality. And then, Hegel’s contract theory differs from those theories in terms of the conditions for contract establishment and the object of the contract. According to this, Hegel, unlike those theories, insists on the substantive equality between persons and excludes the forms of the ethical life, such as marriage or the state, from the object of the contract.
