지방의회와 집행부의 정보비대칭에 대한 검토 -전문위원의 전문성과 서류제출요구권을 중심으로-

지방자치법 전부개정을 통해 지방의회의 인사권 독립과 정책지원전문인력 도입 등 지방의회 역량강화를 위한 새로운 전기가 마련되었다. 그러나 지방의회가 가지는 민주적 대표성과 함께 전문성을 확보하기 위한 위원회 운영에 대한 관심은 여전히 미흡하다. 위원회에서 안건을 심의하여 본회의에 상정하면, 본회의는 위원회 심의결과를 존중하여 의결한다. 이는 전문위원을 두고 소관업무에 대한 지속적인 의정활동을 통해 확보한 위원회의 전문성에 대한 존중이다. 지방자치의 올바른 정착을 위해서 지역상황에 맞는 위원회의 역할이 필요함에도 지방의회 전문위원의 직급과 정수는 대통령령으로 제한하고, 집행부에서 파견된 전문위원은 갖은 인사이동을 하고 있으며 집행부에 대한 전문위원의 자료제출요구는 인정되지 않고 있다. 이처럼 위원회 구성 및 운용의 어려움과 전문위원의 전문성 부족 등으로 발생하는 의회와 집행부 사이의 정보비대칭은 불필요한 오해와 갈등을 초래하여 갈등비용을 늘리고, 지방자치제에 대한 주민불신을 확산시킨다. 따라서 이 연구는 지방의회와 집행부의 정보비대칭을 극복하고, 지방자치제를 올바르게 확립하기 위해 전문위원 직급과 정수에 대한 지방의회의 자율성 확보, 전문위원의 전문성 축적, 집행부 자료에 대한 정당한 접근권한의 확보 등의 방안을 제시한다.
Abstract
The general revision of the local government act provided new opportunity for strengthening the capacity of local councils, such as the independence of the authority over human resources of local councils and the employment of specialists for supporting policy making. But there is a lack of interest in operating committees in the local council to enhance the expertise with the democratic representation. The committee deliberate on the agenda and submit to a plenary session, and the vote for a scheme with respect to the committee’s deliberation. that is a respect for the expertise of the committee, which is accumulating the experience of that field with acting on council. However, despite of this importance, the rank and number of the expert advisor in the committee are limited by the presidential decree. and many expert advisors sent from the administration and execute personnel transfers for short terms. In addition, the request for the submission of reference by a committee is not recognized. the asymmetric information between the council and the executive cause to the lack of expertise of committee make the unnecessary misunderstanding and conflict, increasing social cost and expanding residenter’s distrust of the municipality. Therefore, in order to overcome the asymmetry information and establish the correct municipality, this study is about the ways to secure the autonomy of the local council over the rank and the number of expert members in the committee, enough service period for accumulating the expertise and the right of access to the policy data making by the execute.
