개성공단투자의 정치적 위험과 관리방안

개성공단사업은 북쪽의 토지와 노동력, 남쪽의 자본과 기술이 결합된 ‘접경지역의 남북공동 경제개발 시범사업’으로 인건비 등 고비용 구조로 어려움에 처한 우리 중소기업에게는 중국과 베트남을 대체할 수 있는 투자처로 여러 장점을 제공한다. 개성공단사업이 남북 양측의 적극적인 지원 하에 진행되고 있기는 하지만 한편, 법적, 제도적 불확실성의 사각지대에 놓여 있기 때문에 정치적 위험에 대한 불안이 투자에 제약요인이 되고 있다. 즉 이 사업은 2002년 12월에 합의된 ‘남북사이의 투자보장에 관한 합의서’를 기초로 남북경협차원에서 진행되고 있어 개성공단투자의 정확한 법적지위는 애매한 부분이 많다. 따라서 본 연구에서는 최근 많은 우려와 불확실성을 안고 있는 개성공단사업이 어떤 법적, 제도적 근거를 갖고 있으며 어떤 정치적 리스크를 갖고 있는지를 규명하여 개성공단투자에 따르는 정치적 위험의 특성을 분석하고 이러한 정치적 리스크에 대한 관리방안을 검토해 보고자 한다.개성공단투자에 따르는 정치적 위험은 한국수출입은행과 수출보험공사를 통한 정책적 손실보조제도와 남북투자보장협정에 의존하고 있지만 기업들의 활발한 투자를 유도하기에는 많은 불확실성이 상존하고 있다고 본다. 현재 미국은 북 핵 사태 이후 금강산사업에 대해선 부정적인 입장을 보이고 있으나 개성공단사업에 대해서는 이해한다는 입장을 보이고 있다. 그러나 개성공단사업은 정치상황에 따라 향후 계속 논란의 대상이 될 가능성이 있다. 따라서 원래의 취지대로 중소기업들에게 해외투자처의 대안으로서 이용될 수 있으려면 이러한 불확실성의 실체와 리스크의 크기를 분명하게 인식시켜야 할 것이다. 또한 투자에 따르는 확실한 구제책이 마련, 제시되어야 할 것이다
Abstract
This paper examines whether the political risk has arisen from investment in the Gaeseong Industrial Complex. Since the late 1990s, the North Korea has consistently sought some economic assistances from the international community. As a result of their efforts and thanks to locational merit, the Gaeseong Industrial Complex has been developing as a successful Special Economic Zone. While direct investment in this area gives a good opportunity for concerned firms with its comparative advantages such as low labor cost, low-costed factory site, etc., On the other hand the uncertainties associated with North Korea's regime and international political circumstances are getting worse. Though the political risk has been covered by the Agreement of Investment Guarantees and institutional safeguard, North Korea's unstable foreign relation has been a major factor hindering the entrance of foreign companies into the SEZ. Therefore, Korean firms should perform risk assessment in advance and continuous risk management with various tools for successful investment in the Gaeseong Industrial Complex.
