사회도덕을 법으로 강제하는 것이 정당화될 수 있을지는 법철학에서 중요한 문제이다. 데블린은 하트와의 논쟁에서, 그리고 스티븐은 밀과의 논쟁에서 그 가능성을 긍정하였다. 이 연구는 데블린과 스티븐의 논변을 비교하고, 그들의 생각을 근대 이후 서구의 보수주의 정치사상의 맥락에서 이해할 가능성을 검토한다. 스티븐과 데블린은 사회도덕을 법으로 강제할 가능성을 긍정하고, 형벌의 목적을 예방만이 아니라 응보에서도 찾으며, 자유를 소중하게 여기면서도 사회의 통합과 질서가 자유의 조건임을 강조하고, 법과 도덕 및 종교의 상호연관을 중요하게 생각하였다. 두 사람의 이런 생각은 근대 이후 서구의 보수적인 정치사상과 연관지어서 볼 때 잘 이해될 수 있다.
Abstract
Whether the legal enforcement of morality can be morally justified or not is a crucial issue in jurisprudence. J.F.Stephen(1829-1894) and P.Devlin(1905-1992) took the position of affirming the justification in their respective debates with J.S.Mill and H.L.A.Hart. This study aims to compare their thoughts on that issue and to understand them in the context of modern conservative thoughts in the West. Stephen and Devlin criticized J.S.Mill’s “Harm Principle”, opposing the thought that there could be a simple principle which guides the legal enforcement of morality. Instead they proposed that we should approach those issues individually and concretely under the principle of proportion and the consideration of practical matters. They understood the nature of human-beings and their social lives in a realistic and conservative way. We need to pay attention to the different views of the world underlying the different thoughts on the legal enforcement of morality.
