EU의 정보통신분야 공동규제정책 분석 : ‘망 중립성’논쟁과 현황을 중심으로

본 논문은 통신 산업 분야에서 EU의 정책 및 규제 변화 및 최신 동향에 관하여 특히 망 중립성 논의 및 트래픽 관리를 중심으로 분석하였다. EU는 정보 통신 분야의 경쟁력 제고를 위해 2002년 동 분야의 규제 체계를 개선하기 시작하였으며, 2007년 규제 개혁 초안을 작성하여 의견 수렴 및 합의 과정을 거쳐2009년 규제 개혁 최종안을 공표하였다. 이를 통해 역내 통신 산업의 경쟁력제고 및 요금 인하 등 긍정적 결과를 도출하였으나, 기술의 비약적 발달, 통신서비스 제공 분야의 융합 및 통합 등 다양한 발달 상태를 규제하기에 미흡하다는 지적을 받고 있다. 본 연구는 통신 산업 분야에서 진행되고 있는 EU의 규제 설정 동향에 관하여 고찰하고, 통신 산업에 대한 공동체의 재규제가 경제적으로 배타적 이익을추구하는 보호 장벽으로서 기능할 수 있을지에 관하여 예측하였다. 또한 현재동 산업 분야의 문제를 EU의 정책 결정 시 재규제 과정에서 도출되는 문제점분석과 함께 규제에 관한 의견 수렴 과정에서 공동체의 입장이 조율되어 정책조화를 나타내는 ‘초국가주의’로 나아갈 수 있을지에 관하여 중점적으로 분석하였다.
Abstract
This research mainly analyzes the EU Common policy and regulation in ICT(Information and communication technologies) sector, with special focus on net neutrality and traffics management. In 2002, EU started to reform the regulation scheme in order to boost competitiveness in ICT of the Union. Since then the Commission firstly drafted scores of regulations and actions in 2007. And in 2009, the final framework directive (Regulatory framework for electronic communications networks and services) is released. Although it is clear that this common regulatory framework in ICT provides the EU with positive outcomes such as strengthening competitiveness and a rate cut, its policy and regulation are, to some extent,inadequate to deal with various problems in ICT which keep constantly evolving. This paper aimed to review on the new regulatory framework and some public consultations for electronic communications networks and services,and investigated whether these reregulations will consequentially pull their share of the weight to seek a exclusive profit of the union or not. Also,author asserts that the new trend assertregulatory framework in ICT will enhance not the er's supranational nature but the intergovernmental nature.
