망중립성 이슈에 대한 논란과 각국 정책당국의 논의가 진전되고 있는 가운데 세부적인 쟁점을 파악하고 이에 대한해결방안을 도출해야 할 필요성이 높아지고 있다. 본 논문에서는 경쟁법적 접근이 망중립성을 분석하기 위한 가장 적합한 방법론이라는 인식 하에 이를 바탕으로 주요 쟁점들을 분석하였다. 아울러 통신규제 및 산업정책의 관점에서도망중립성 규제의 타당성을 뒷받침할 수 있을지를 검토하였다. 이를 바탕으로 최근 발표된 방송통신위원회의 망중립성가이드라인의 내용을 비판적으로 검토하고 시사점 및 개선방안을 도출하였다.
Abstract
As the controversy over the network neutrality intensifies in many countries, we get to the stage in which detailed issues should be identified and analyzed to seek for the solutions. This paper recognizes that the competition law provides the best tools to analyze the net neutrality issues and take the approach in combination with traditional telecom regulatory and industrial policy framework. Based on the results, the paper then makes critical assessments of the net neutrality guidelines announced by Korea Communications Commission and suggest possible modifications.
