정책네트워크 관점에서 KT합병인가 정책결정과정 연구

초록

정책네트워크란 정책행위자간 공식적, 비공식적 네트워크가 정책결정에 영향을 미치는 핵심요인이라는 입장에서, 네트워크 관계구조에 입각해 정책결정과정의 특징을 설명하려는 접근이다. 이에 본 연구는 KT･KTF 합병인가 정책결정과정의 특징을 정책네트워크 관점에서 분석하였다. 분석결과, 정책환경 측면에서 유선전화 시장이 급격히 쇠퇴하고 무선시장이 확산되고 있으며, 이에 글로벌 통신사업자들은 자국과 해외에서 유무선 통합서비스 제공역량을 갖추기 위해 인수합병에 적극 나서고 있었다. 이런 점에 비춰볼 때 유무선 사업자의 합병이 전반적인 시장트렌드라는 점을 확인했다. 정책결정과정 측면에서는 정책결정과정 초기 참여자 수가 다양하고, 정책행위자의 상호의존성, 참여배제성, 관계지속성 등이 높지 않았다. 또한 공정거래위원회는 수차례 간담회, 토론회, 실질심사 등을 진행하고, 방송통신위원회는 사업자 의견청취 과정을 공개하는 등 투명성을 높이고자 노력했다. 그럼에도 불구하고 KT･KTF 합병인가 심의과정에서 규제기관은 갈등관계에 있는 사업자 중심으로 의견을 수렴함으로써, 다양한 행위자가 참여하여 정책대안을 제시하고 검토할 수 있는 논의구조가 형성되지 못했다. 또한 신임 KT회장이 과거 정보통신부 장관을 역임한 관료로서 규제기관과 밀접한 관계를 형성하고 있다는 점, 변화와 속도를 강조한 KT회장의 경영기조에 부응하여 규제기관이 신속한 정책결정을 내렸다는 점, 과거 SK텔레콤의 하나로텔레콤 인수에 다양한 인가조건을 부여했던 경우와 달리 공정거래위원회가 KT합병은 경쟁제한성이 없다고 판단한 점, 방송통신위원회 입장에서는 정책추진 과정에서 KT와 긴밀한 관계를 유지하는 것이 불가피하다는 점 등에 비춰볼 때, 규제기관과 KT사이에 실질적인 우호관계가 존재했다고 판단된다. 결론적으로 이번 KT･KTF 합병인가 정책결정은 외형적으로 절차적 정당성을 갖추고 합리적 결정이 이뤄진 것으로 보이지만 실질적으로는 규제기관과 특정 통신사업자 간의 우호적 관계 속에서 이뤄졌다는 특징을 나타냈다.

Abstract

Policy network explain the character of policy decision process at the stance of network structure among stakeholders because the formal and informal network give more impact on the policy decision of regulator. In this context, this study study on character of KT-KTF merger approval policy decision process at the stance of policy network. As a result, at the aspect of policy decision circumstance, wire telephone service is submerging but wireless service is emerging in global telecommunication market. so global telecommunication companies tried to secure the capability which can serve wire and wireless telecommunication services at once. In that reason, it is considered that KT-KTF merger follow the global trends. At the aspect of policy decision process, many stakeholders participate in that policy decision process at the beginning. And the interdependence, exclusiveness, relationship durability among stakeholders are not strong. Fair Trade Commission and Korea Communications Commission hold many meeting, open forum to elevate the transparency of policy decision process. But, in the merger approval screening process, Fair Trade Commission and Korea Communications Commission mainly heard the companies which have oppose opinion. So many stakeholders who have different opinion could not participate in the policy decision process. Also, new chairman of KT hold a minister of the Ministry of Information and Communication in succession, and as the new chairman of KT emphasize change and speed, regulator responded without delay to decide the merger approval, not like the former case of SK Telecom acquired Hanaro Telecom, Fair Trade Commission decided that there is no competition restriction possibility about KT-KTF merger, and Korea Communications Commission could not help cooperating KT for telecommunication policy in the long term. These reasons explain that there was close relationship between KT and regulators. In conclusion, the policy decision process about KT-KTF merger approval looks a procedural justification and transparency externally. But the policy decision is conducted under informal and close policy network between KT and regulators.
