경찰 다기능 현장증거분석실의 발전방향

최근 경찰은 과학수사의 신기술개발, 국과수 보완적 증거분석 기능 보유 등을 배경으로 전국 각 지방경찰청 단위로 ‘다기능현장증거분석실(crime lab)’을 설치하였다. 이는 경찰 과학수사의 발전 측면에서 상당히 의미 있는 일이지만, 그 실상을 보면 많은 아쉬운 점이 있다. 현재 설치된 증거분석실의 문제점으로는 첫째, 증거분석실에 투입된 시설비와 장비구입비 예산이 각 지방청 평균 1억 4천만 원 정도에 불과하여 본래적 의미의 증거분석실로서의 역할을 할 수 없는 정도라는 것, 둘째, 증거분석실에는 분석 전문 인력이 필요한데 이를 확보하기 위한 구체적인 계획이 아직 없는 점, 셋째, 증거분석실을 설치하면서 기존에 경찰에서 하고 있던 증거분석 기능을 심화하는 쪽으로만 비중을 둠으로써 DNA 분석 등을 포함하여 현대 과학수사의 핵심감정기능 결략하였다는 점 등을 지적할 수 있다. 실제 경찰에서 증거분석실을 설치한 이면에는 현재 국과수의 감정지체로 인해 강력범죄수사에 지장을 받는 부분이 있기 때문이다. 경찰은 이러한 문제점을 해결하기 위하여 자체 증거분석실을 설치하여 현장증거물 중 경찰에서 분석할 수 있는 것은 1차적으로 걸러줌으로써 국과수의 감정 업무를 경감시키겠다고 하고 있다. 그러나 현실적으로 경찰 증거분석실이 이러한 역할에 충실 한다고 하여 국과수의 감정업무가 경감되지는 않을 것으로 생각된다. 왜냐하면 현재 대부분의 강력사건은 DNA분석을 필수적으로 하고 있고, 따라서 경찰에서 1차적으로 걸러줄 수 있는 증거분석 영역은 생각보다 많지 않기 때문이다. 이런 점에 비추어 볼 때 경찰 증거분석실이 스스로의 역할을 위와 같이 한계 짓는다면 당면문제의 해결은 요원할 것이다. 생각건대, 경찰 다기능현장증거분석실은 다음과 같은 지향점을 가져야 한다. 첫째, 업무의 중복성 문제보다는 감정업무량의 효율적 배분 차원에서 접근하여 현재 국과수가 행하고 있는 증거분석 영역을 경찰 증거분석실에서도 같이 다룰 수 있게 하여야 한다. 즉 경찰 증거분석실의 취급 업무에 한계를 두지 말고, 종합적 증거분석기능을 수행하겠다는 지향점이 필요하다. 만일 경찰이 국과수에 버금가는 증거분석기능을 가진다면 국과수와의 감정업무량을 합리적으로 배분할 수 있고, 따라서 감정업무의 부하문제는 해결될 수 있을 것이다. 둘째, 첫째의 조건이 충족되기 위해서는 첨단 분석 장비를 구비하고 그 장비를 운용할 전문가를 채용하여야 할 것이다. 마지막으로 증거분석실 설치를 계기로 일선수사관, 과학수사요원, 증거분석 연구간 간에 원활한 의사소통이 가능하도록 증거분석실이 코디네이터 역할을 할 수 있어야 할 것이다. 경찰 증거분석실이 이러한 지향점을 가져야만 국과수의 감정지체로 생기는 문제점도 어느 정도 해결할 수 있고 장래 과학수사 신기술 개발의 토대도 마련할 수 있을 것이다.
Abstract
Recently, Korean National Police(KNP) established 'Crime Laboratories' in the level of Provincial Police Agencies, for the purpose of developing new techniques and performing a complementary function to National Institute of Scientific Investigation of Korea(NISI). That is valued at new leap in forensic investigation of Korea. However, there are some problems relevant to these crime labs. First, the budget having spent in these crime labs is so small, only 140,000,000won on average, and so it is very difficult to play a role as crime lab. Second, crime labs need experts in analysis of evidence, but there is no plan employing the experts yet. Third, the crime labs have no plans to perform important analytic functions including DNA analysis. The practical reason of establishing crime labs in police agency is to solve the problem of case backlog by NISI. However, the solution would be difficult because of the above problems. So, to solve the problem of case backlog by NISI, the crime labs must have the following future direction First, the crime labs should be able to deal with the equivalent level of forensic analysis function to NISI. That will make the problem of case backlog alleviate by sharing the amount of evidence analysis with NISI. Second, the analysis instruments of the high quality should be equipped and the experts should be employed to satisfy proper standard. Finally, the communication among the criminal investigator, the CSI agent and criminlalists should be needed and the role of coordinator of the communication should be given to the managers of crime labs.
