화환신용장은 모든 신용장 관계자들에게 이익을 보장하고 있기 때문에 가장 많이 사용되고 있는 결제방식이다. 신용장은 수입업자가 은행에게 신용장조건에 일치하는 요구된 서류의 제시시에 수출업자에게 대금을 지급하도록 지시하는 약정이다. 법률체계로서의 UCP 600은 화환신용장을 규율하고, eUCP는 전자적 제시에 대한 장소, 시간, 양식에 대한 새로운 규칙을 포함하여 전자적 제시와 관련된 다양한 특정 문제를 정의하는 계약적 프레임워크를 규정하고 있다. 본 논문은 전자신용장의 법률적 차원에서 전자신용장 도입을 위한 문제점과 개선방안을 제시하고 있다. 본 논문의 연구목적은 글로벌 기반으로 전자신용장의 활성화에 기여하는 것이다.
Abstract
The letter of credit is the most popular settlement method as it assures all the parties to the credit of their interests. The credit is an arrangement whereby an importer instructs a bank to pay the exporter on presentation of required document in accordance with the terms of credit. As legal regime, the UCP 600 regulates letter of credits and the eUCP sets out a contractual framework defining various specific matters regarding electronic presentation including new rules for the place, time and format for electronic presentation. This paper presents the problems and promotions for the adoption of electronic letter of credit in the legal regime of electronic letter of credit. The purpose of this paper is to contribute to the activation of electronic letter of credit on a global basis.
