초록

국제상업회의소 작업반은 전자적 제시 또는 eUCP를 위하여 신용장 통일규칙의 새로운 부칙을 제정하였다. eUCP는 2002년 4월 31일에 발효되었다. 그것은 국제무역에서 사용되어온 전자서류의 증가에 따른 ICC의 대응이었다. 수년간의 작업의 결과로서, eUCP는 신용장이 일방적으로 이용되는 방법을 혁신화할 것이다. eUCP는 신용장(예를 들면, 전통적인 종이기반의 신용장 또는 전자신용장)의 형식에도 불구하고 전자적인 기록의 제시로 한정되어 적용된다. 전자적인 기록의 제시는 종이서류의 제시에서 볼 수 없었던 약간의 문제를 지니고 있다. 따라서 본 논문의 목적은 eUCP의 특성을 살펴봄으로써 eUCP의 이해를 높이고자 하는 것이다.

Abstract

The Working Group of International Chamber of Commerce made the new Supplement to the Uniform Customs and Practice for Documentary Credits for Electronic Presentation or “eUCP”. The eUCP came into force at 31 March of 2002. It was a response by the ICC to the growing number of electronic documents being used in international trade. As the product of more than two years of work, the eUCP is expected to revolutionize the way letters of credit are commonly used. The eUCP is only apply to the presentation of electronic record regardless of type of L/C (for example, traditional paper L/C or electronic L/C). The presentation of electronic record has some problems which have not be seen in the presentation of paper document. Therefore, the purpose of this paper is to enhance the understanding of eUCP by studying the characteristics of the eUCP.
