2012년 대법원은 친족‧상속법 영역에서 중요한 법리를 선언하는 판결을 하였다. 이혼시 친권자와 양육권자를 다르게 정할 수 있는지 여부 및 공동친권자로 정할 수 있는지 여부, 배우자와 친족사이의 부양료 구상, 제사주재자지위 확인 청구와 확인의 이익, 한정승인 후 상속재산이 임의경매로 매각된 경우 한정승인상속인에 대한 양도소득세 부과, 유류분반환청구권의 소멸시효 중단사유, 출생⋅사망일시의 정정과 가족관계등록부 정정 허가 신청 등이다. 한편 서울가정법원은 양육비산정기준표를 제정, 발표하였다.
Abstract
In 2012, the Supreme Court made important decisions on domestic relations. For example, the relationship between parental right and custody after divorce, the duty of support between spouses and the duty of support between other relatives, about the person who is responsible for ancestral ceremony, qualified acceptance and tax, correction of family register.
