블록체인과 가상(암호)화폐 관련 범죄에 대한 최근 이슈와 형사법적 대처방안의 모색

본 논문에서는 블록체인과 가상화폐와 관련된 범죄에 현행 형법 규정을 적용할 수 있는지, 없다면 어떠한 방향으로 입법적 개선을 해야 하는지에 대하여 검토해 보았다. 블록체인의 특성인 탈중앙화, 분산성, 투명성 및 비가역성 그리고 익명성 등과 판례가 인정하고 있는 가상화폐의 재산성(재산상 이익) 인정 등을 고려할 때 가상화폐를 둘러싼 새로운 형태의 범죄에 대처하기에는 현행 형법의 체계와 규정으로는 충분한 대처가 부족한 것을 알 수 있다. 본 연구에서는 현행 형법상 재물과 재산상 이익으로 구분되어 있는 재산범죄의 체계상 구조를 현재의 가상경제의 특성을 고려하여 무형물이라고 하더라도 행위의 특성을 고려하여 범죄가 성립할 수 있도록 해야 하고, 현행 문서와 전자기록의 구분도 블록체인의 특성에 맞게 전자문서의 문서성을 인정할 수 있도록 해야 함을 서술하였다. 나아가 메타버스 등 새로운 인터넷 환경에서 발생할 수 있는 블록체인 기반의 네트워크 범죄에 대처할 수 있는 법리의 개발과 입법, NFT 관련 산업과 관련된 법적 이슈를 해결할 수 있는 법해석이나 입법적 보완 등에 대하여 논의하였다.
Abstract
In this paper, it is reviewed whether the provisions of the current criminal law can be applied to crimes related to blockchain and virtual currency, and if not, in what direction legislative improvement should be made. Considering the characteristics of blockchain decentralization, decentralization, transparency and irreversibility, anonymity, and the recognition of property (property benefits) of virtual currency that are recognized as precedents, it is difficult to cope with new types of crime surrounding virtual currency. . It can be seen that the measures against the system and regulations of the criminal law are insufficient. In this study, considering the characteristics of the current virtual economy, the systematic structure of property crimes, which are divided into property and property interests under the current Criminal Act, should be made so that crimes can be established in consideration of the characteristics of actions, even if they are intangible. It was also described that the distinction between current documents and electronic records should be made so that the documentary nature of electronic documents can be recognized according to the characteristics of the block chain. Furthermore, I discussed the development and legislation of legal principles that can cope with block chain-based network crimes that may occur in the new Internet environment such as Metaverse, and the interpretation of laws or legislative supplements that can solve legal issues related to NFT-related industries. Through this discussion process, it is expected that a more in-depth discussion will develop on the direction of criminal legislation that can cope with the development of new information and communication technologies in the future.
