이 연구의 목적은 ‘공감’(Compassion)이 어떻게 ‘공적 감정’(Public Emotion) 으로서 역량을 발휘할 것인지, 그 가능성과 한계를 공감의 ‘인지적 구조’ (Cognitive Structure)을 통해 밝히는데 있다. 누스바움(M. Nussbaum)에 따르면, 공적 감정은 여과, 정화, 선택 과정을 거쳐 형성되며 ‘공동-추론’(Co-duction)이라는 절차를 통해 공적 합리성에 기여할 수 있게 된다. 이 연구는 공감에 대한 ‘정치적 감정이론’을 정립하기 위해 누스바움의 법철학과 그것의 비판적 토대가 되는 니체의 윤리학을 비교하여 ‘공적영역’(Public Sphere)을 구성하는 ‘공감의 인지적 구조’를 스토아주의와 자연주의 논쟁을 중심으로 밝히고자 한다. 공정한 재판관의 역량으로서 공감의 필요성을 강조하는 누스바움의 견해는 첫째, 스토아학파에 대한 비판, 둘째, 아담 스미스(A. Smith)의 관찰자이론 수용, 셋째, 공감에 대한 인지적 구조 분석으로 요약된다. 논자는 니체의 자연주의(Naturalism) 관점을 가져와 누스바움의 공감이론의 딜레마를 분석하고 이론적 체계를 보완하려고 시도할 것이다.
Abstract
The purpose of this study is to reveal how the ‘compassion’ will emerge as ‘public emotion’ through the ‘cognitive structure’ of emotion. According to M. Nussbaum, public feelings are formed through filtration, purification, and selection processes and can contribute to public rationality through a process called ‘co-duction’. In order to establish the ‘political emotion theory’ i try to explain ‘cognitive structure of sympathy’ that can be a basis of law philosophy Nussbaum’s and the critical foundation of Nietzsche’s ethics between stoicism and naturalism. Nussbaum’s view emphasizing the need for empathy as a just judge’s capacity is summarized: first, criticism of the Stoics, second, acceptance of A. Smith’s Theory of Observers, third, the cognitive structure-analysis of empathy. I will attempt to bring to Nietzsche's naturalism perspective and analyze the dilemma of Nussbaum’s empathy theory and to complement the defect of theoretical framework.
