인터넷규제의 정치: 내용규제 레짐의 고찰을 중심으로

이 글에서는 우리사회의 인터넷 내용규제레짐(contents regulatory regime)의 특성을 고찰한다. 정치현상으로서 내용규제를 이해할 때, 규제레짐은 규제장치들을 매개한 주체들간 정보통제권의 제도적 분할구조를 의미한다. 이러한 규제레짐의 등장은 2000년대를 전후로 본격화되었는데, 기실 인터넷 백본(backbone)의 확장기에 우리나라를 비롯해 주요 국가들은 네트워크의 성장을 촉진하기 위하여 탈규제(de-regulation) 정책을 견지하였다. 그것은 첫째, 인터넷이 매우 시장추동적 전망이 강했기 때문에 그것을 위축시키지 않으려 했던 점, 둘째, 인터넷이 탈경계적 글로벌 네트워크로서 단일한 규칙을 적용하기 어렵다는 점 때문이었다. 따라서 국가 개입은 주로 정보화 인프라 구축과 시장 활성화 분야에 집중되었으며, 그 외의 분야에서는 ‘비개입주의’ 또는 ‘제도적 진공’ 상태가 유지되었다. 그렇지만 인터넷의 광범한 ‘상업화와 역기능’의 부상은 체계적인 국가 개입 및 다양한 규제장치의 동원을 불러들였다. 주목할 점은 정보주체들간 정보통제권 이니셔티브 또는 배분구도에 따라 국가별 규제방식이 대조적으로 나타나고 있다는 점이다. 이 글에서는 한국 사례를 통해 정부주도형 규제레짐의 특성과 시사점을 경험적으로 논의하고자 한다.
Abstract
This paper intends to analyze characteristics of Internet contents regulatory regime. We understanding contents regulation as political phenomenon, Internet regulatory regime means institutional distribution arrangement of information empowerment. Therefore regulatory regime mediated interaction of interested parties. In other words, the conflicts of information ownership and control form cleavage structure of information society as like ‘contents regulation v. free speech’, ‘intellectual property v. information sharing’, ‘surveillance v. privacy.’ These collection of anti-theses imply various interests and conflict to strengthen information empowerment. Especially It is worthy of notice that contrastive types of regulatory regime appears according to each state's policy and intervention. This paper intends to characteristics and implications of government-led regulatory regime, focusing on the korean examples.
