저작권, 사이버 모욕제, 인터넷 내용규제 등 인터넷과 포털사이트 관련된 다양한 이슈 중에서 포털의 언론기관 적용여부 문제와 사이버모욕죄, 인터넷 실명제 등의 쟁점을 살펴보고, 규제정책의 속성에 대한 논의를 통해, 최종적으로 우리나라의 정치 환경에서 이상적인 규제 방향은 무엇인지에 대해 알아보았다. 표현의 자유와 인격권보호의 상생을 위해서 인터넷에 대한 규제는 점증하는 인터넷의 사회적 영향력을 고려할 때 결코 방임할 수는 없는 문제다. 따라서 포털에 자율규제의 권한을 더욱 위임하고 강화하는 자율규제의 구체적 실행을 유도하고 강화하는 방안이 필요하다. 특히 인터넷 커뮤니케이션이 우리나라의 상황에서 많은 사회적 영향을 주고 있다는 점을 감안한다면 더욱 그러하다. 최근 포털에 명예훼손 책임을 확정한 판결을 감안하면 포털을 위해서도 자체적인 심의 및 규제 기구는 필요한 일이다. 구체적인 자율규제 실천방안으로 행동강령의 구체화와 실행, 미디어교육 강화, 심의제도개선, 언론중재위의 역할 강화 등을 제언하였다.
Abstract
This study investigated what would be the ideal policy of internet communication under the current political circumstances. First, this article reviewed current movement such as reinforcement of copyright act, slander, and content regulation in the realm of the Internet. Afterwards, it explored the nature of regulation and self-regulation. By doing so, this study recommended that portal should be considered as mass media and so regulation is needed corresponding to its media power and responsibility in order to balance freedom of expression and human rights, such as slander, libel, and copyrights. Yet, it suggested more ideal policy direction for the Internet would be self-regulation viewing from the dynamic, interactive, and democratic nature of Internet. This study finally suggested the manual of concrete operation of self-regulation such as an establishment and activation of codes of conducts by portal media, the efficient use of internet filtering technology, the reinforcement of media literacy for general users, the positive role of the Press Arbitration Commission, and working on a more effective monitoring system by private institutions.
