고용상 구조적 차별의 시정과 적극적 조치 : 캐나다의 논의를 중심으로

우리나라에서 고용상 성차별을 시정하기 위한 ‘적극적 조치’를 규정하는 대표적인 법률은 「 남녀고용평등 및 일･가정 양립 지원에 관한 법률」과 「양성평등기본법」이다. 그러나 적극적 조치와 관련한 기존의 연구는 적극적 조치의 시행을 위한 법리적 근거보다는 주로 적극적 조치의도입으로 인한 역기능에 대한 우려나 법률 및 당사자의 계약으로 정한 적극적 조치의 정당성등에 대해 미국이나 유럽 등의 사례를 검토하고, 이를 주로 평등권의 관점에서 논의하는 경향이 있다. 적극적 조치 시행의 법적 근거가 되는 ‘현존하는 차별’을 어떠한 법리에 의해 규명하고 판단하며, 법률상 적극적 조치의 미이행에 대한 법적 책임과 사법심사로서 그 시정을 행할수 있는지 여부 등에 대한 법리적 연구는 부족했던 것으로 보인다. 반면, 이 연구의 중심에 있는 캐나다의 사례는 적극적 조치의 시행에 대한 법리적 근거를‘구조적 차별’(systemic discrimination)로 명명하고, 구조적 차별의 판단기준과 구조적 차별을 시정하기 위한 사법적 구제의 필요성을 매우 명확하게 드러내 주고 있다. 특히, 인권사건에서 1차 관할권이 있는 인권심판소(인권위원회)를 포함한 사법부가 구조적 차별을 인권법에서금지하는 차별로 보고, 할당제를 통한 구제명령을 하고 있다는 점은 우리에게 매우 큰 시사점을 제공한다. 이러한 캐나다 사례의 검토는 차별을 구제함에 있어 과거의 침해만을 구제 대상으로 하는 구제신청에 기초한 모델로는 왜 충분하지 못한가를 설명하는 데에 유용하게 인용될수 있으며, 적극적 조치를 시행하기 위한 전제로서 고용상 ‘현존하는 차별’ 즉, 구조적 차별개념의 설정과 그 판단기준, 이를 사법심사의 대상으로 보아 적극적으로 시정할 수 있는지 권한이 사법부에 있는지 여부 등에 대한 이론적 근거를 제공한다. 이 글에서는 적극적 조치를 시행하기 위한 법리적 근거로서 오랜 세월 동안 사회구조적으로발생되어 온 고용상 차별 현상을 시정하기 위한 캐나다의 법리와 대응을 ‘성’을 중심으로 살펴보고 그 시사점을 제공한다.
Abstract
In South Korea, affirmative action for rectifying the gender discrimination in employment is regulated by two laws: the “Act on Equal Employment and Support for Work-Family Reconciliation” and “Framework Act on Gender Equality.” But those Acts do not include the criteria of the standard of judgement about ‘existent discrimination’. And also, when failure to perform the law by the employer, it is possible to subject to judicial review and through such review the judicial authority could order quotas. However, these have not been discussed in the academic literature. On the other hand, in the case of Canada — the focus of this study — the criteria and necessity of judicial remedy of systemic discrimination is indicated very clearly. Judicial basis for the implementation of affirmative action is named "systemic discrimination" in the Canadian Human Rights Act. In this article, through examination of the Canadian case, I introduce the concept of systemic discrimination and the rationale for applying the affirmative action, and outline how to set the criteria of systemic discrimination. In particular, these are meaningful as they provide implications for the jurisdiction of judgment on systemic discrimination as subject to judicial review and the failure of enforcement to perform affirmative action.
