최근 성희롱은 ‘성폭력’, ‘괴롭힘’ 이슈와 더불어 고용부문에서는 물론 학교 등 비고용부문에서도 빈번하게 발생되고 있는 것으로 보고된다. 그런데, 성희롱에 대한 법적 규율에도 불구하고, 법적 용어, 개념 및 판단기준에서 여전히 명확한 기준을 확립해 나가지 못하고 있는 것으로 판단된다. 즉, 성희롱의 법적 개념, 성립요건 및 판단기준이 피해자의 인지적 관점에 따라 가변적일 수 있도록 규정되거나 해석되고 있고, 「남녀고용평등법」, 「양성평등기본법」에서는 성희롱 예방조치와 관련한 기준을 마련하고 있으나 개별 조직이나 기관이 자율적으로 대응할 수 있도록 하는 제도적 장치를 마련하지 못하고 있다. 성희롱 규율의 실효성 확보는 개념 및 판단기준의 규율에서부터 사전적 예방, 사후적 대응방식 등에 이르기까지 일련의 과정과 밀접하게 연관되어 있다. 하지만 용어의 모호함과 더불어, 법적 개념, 판단기준 등의 미비는 가해자에게는 그 부당행위의 당위성을 강화하도록 하고, 피해자에게는 그 부당행위를 수용하도록 하는 구조적인 원인으로 작용하게 된다. 특히, 성희롱은 조직 내에서 발생되는 경우가 대부분이어서 문제제기 이후 피해자가 오히려 조직 내에서 비난의 대상이 되거나 2차 피해의 대상이 될 수 있다는 점에서 더욱 은폐될 수 있는 가능성이 크다. 본 연구에서는 캐나다의 고용부문과 교육부문을 중심으로 성적 괴롭힘의 개념과 판단기준에 대해 검토하고 그 시사점을 도출하여 향후 우리 법제 개선의 기초자료로 제공하고자 한다.
Abstract
In recent years, in Korea sexual harassment has occurred frequently in the education sector as well as in the employment sector as issues of ‘sexual violence’ and ‘sexual harrassment’. However, there is a gap between the legal regulation and application of legal terms, concepts, and judgment standards related to sexual harassment regulations. Providing consistency in the resolution of cases has also been problematic because of the sheer number of remedying organizations. In other words, the legal concept, requirements for establishment, and judgment criteria of sexual harassment are defined or interpreted variably according to the remedying organization’s point of view. While the ‘Gender Equality Employment Act’ and the ‘Gender Equality Fundamental Law’ in Korea introduce the legal measures of prevention related to sexual harassment, these laws do not provide an institutional device that allows individual organizations (such as employers, schools, etc.) to respond autonomously. Overall, there is no consistent responding procedures for sexual harassment, which increases the social cost and may result in inconsistent judgments. The purpose of this study is to examine the concept of sexual harassment, criteria of its judgment in the Canadian employment and education sectors in order to provide lessons for Korea.
