현재 한국에서는 제주특별자치도에서만 자치경찰제가 실시되고 있고 제도의 불완전함으로 인해 진정한 의미에서 자치경찰제는 요원한 상황이다. 따라서 전국적으로 지역에 적합한 치안서비스를 제공할 수 있는 자치경찰제의 도입은 필수적이라고 하겠다. 이에 현 정부에서는 「경찰법」을 전면 개정하여 「국가경찰 및 자치경찰의 조직 및 운영에 관한 법률(안)」을 의원입법으로 발의하였고 현재 국회에 계류 중이다. 이 법률은 자치경찰제 도입의 법적 근거를 마련하여 주민 수요에 적합한 다양한 치안서비스를 제공하고 국가 전체의 치안역량을 강화하는 데 목적을 두고 있다. 이에 본 연구는 주민참여의 보장이라는 관점에서 현 정부안에서 도입하려는 시·도 경찰위원회를 고찰하고 이와 함께 일선 공무원들의 인식조사를 통하여 파악한 자료를 바탕으로 바람직한 시·도 경찰위원회제도의 구성 및 운영 방안을 제시하고자 하였다. 현 정부안의 시·도 경찰위원회는 과거 역대 정부가 주장한 시·도 경찰위원회를 다소 발전시킨 방안으로 생각되나, 시·도 경찰위원회가 실질적이고 능동적인 주민참여의 통로로 기능하도록 하기 위해서는 향후 입법과정에서 다음과 같은 사항들이 보다 심도 있게 검토될 필요가 있다고 본다. 첫째, 시·도 경찰위원회는 단순한 심의·의결기관으로 형식적인 주민참여가 아닌 능동적이며 실질적인 주민참여의 실현과 정치적 중립성을 확보하기 위하여 독립적인 행정위원회 기관형태로 설립되어야 한다. 또한, 시·도 경찰위원회의 자치경찰에 대한 관리·감독의 실효성을 확보하기 위하여 시·도 경찰위원회의 정책에 대한 결정권과 감독권을 부여하는 방안을 입법화해야 한다. 둘째, 주민참여를 활성화하는 측면에서 시·도 경찰위원회의 위원은 7인 이상 10인 이하로 하는 것이 효율적인 운영을 위해 적정하다고 사료된다. 이때 1인의 위원을 대법원이 추천하는 것은 주민참여의 취지와 부합하지 않으므로 재고할 필요가 있다. 셋째, 시·도 경찰위원회의 서무는 독립하여 수행토록 하고, 위원회의 임무를 수행하기 위한 사무국을 시·도 경찰위원회 내에 두는 것을 고려할 필요가 있다.
Abstract
Currently, only the Jeju Special Municipal Province has a Municipal Autonomy police system, and due to the incomplete system, the real Municipal Autonomy police system is a long way off. Therefore, it is said that it is essential to introduce a Municipal Autonomy police system that can provide adequate security services to the regions nationwide. Accordingly, the current government proposed the 「Act on the Organization and Operation of National Police and Municipal Autonomy Police」 by revising the 「Police Act」 and is currently pending in the National Assembly. The law aims to provide various security services suitable for the needs of residents and strengthen the security capabilities of the entire nation by providing legal grounds for the introduction of the Municipal Autonomy police system. In this study, the city and provincial police committees were reviewed to introduce them from the perspective of guarantee of residents’ participation, and at the same time, based on data identified through a survey of the perceptions of frontline government officials, the government wanted to present desirable measures to organize and operate the city and provincial police committee system. While the municipal and provincial police committees of the current administration are thought to have improved the city and provincial police committees somewhat, they believe that the following matters need to be considered in the future legislation process in order to ensure that the city and provincial police committees function as channels for practical and active participation of residents. First, the institutional form of the municipal and provincial police committee should be established as an independent administrative committee to ensure active and practical participation of residents and political neutrality, not as a mere deliberation and decision-making institution. In addition, a measure should be enacted to give the municipal and provincial police committees the right to decide and supervise the policies of the municipal and provincial police committees in order to ensure the effectiveness of the management and supervision of the autonomous police. Second, it is necessary to have at least seven members of the city and provincial police committees in terms of boosting residents’ participation. On the other hand, considering the efficiency of the operation, it would be appropriate to make up a seven-ten-member committee, and the Supreme Court’s recommendation of a single member should be raised to be far from public participation. Third, it is necessary to make the ordination of the municipal and provincial police committees independent and to consider having the secretariat within the city and provincial police committees to carry out the commission’s duties.
