초록

This thesis focuses on the documents written in Hangeul among the petitions of the Joseon Dynasty; reviews the background of their writing, legal effect, authors and submission process in general, and the names and styles of Hangeul petitions; analyzes the litigation process through translation and the type of disposition. Since petitions in the Joseon Dynasty had to be written in a combination of Chinese characters and Idu transcription, women and ordinary people unfamiliar with Chinese characters had no choice but to write them with help from those around them. However, there are occasional petitions written in Hangeul. Due to the nature of the petition, which had to be written in a specific format, the Hangeul petitions were also ghostwritten by expert intellectuals, but the petitioner had to submit it him/herself. In addition, petitions in Hangeul were received without much restriction not only by local government offices but also by the king and took legal effect according to the results of the disposition of the government office. The names of the documents pointing to the Hangeul petition are ‘Wonjeong(原情),’ ‘Danja(單子),’ ‘Eundan/Eondan(諺單),’ ‘Eondanwonjeong(諺單原情),’ ‘Balpaol’ (Balgwal) (白活),’ but it is characterized by not using the name of ‘Soji (所志),’ which is commonly used in Chinese petitions. In order to facilitate communication with the petitioner, the local administrative office allowed the petition in Hangeul, but the hassle of translating it into Chinese was involved in the preservation of the document. Therefore, it was only natural that the contents of the government's disposition for the Hangeul petition should also be written in Chinese. It can be seen that the Hangeul petition was used as one of the winning strategies for an illiterate petitioner to convey his or her argument effectively, and the government offices placed importance on communication with the petitioner despite the hassle of translation.
