대검찰청 중앙수사부 개편의 경로진화 연구– 역사적 제도주의의 경로의존 모형과 경로진화 모형을 중심으로 -

본 연구는 52년간(1961-2013년) 대검찰청 중앙수사부의 변화 과정을 경로의존과 경로진화의관점에서 분석함으로써 대검 중수부 제도유지의 지속성과 제도변화의 요인을 규명하고 정책적 함의를도출하고자 하였다. 분석 결과, 검찰개혁의 상징이었던 중수부 제도는 2013년 폐지되기 까지경로의존(path dependence) 모형에서 제시하는 우연성과 결정적 시기를 계기로 시작되어 수차 외부적충격에도 경로전환이 무산되는 과정을 거쳐 장기간 존속하였으며, 이후 중수부의 제도변화 역시검찰의 기소독점권은 변화 없이 경로진화 중 가겹(layering) 형태로 나타났음을 확인하였다. 향후검찰은 여전히 강력한 독점적 정책옹호연합을 형성하면서 기소독점주의라는 폐쇄적 경계를 유지하고있어 검찰 수사 기능의 조정 등 근본적 제도변화가 나타날 가능성이 낮은 것으로 전망된다. 결과적으로중수부가 내외부의 변화요인에도 불구하고 장기간 경로유지를 하였다는 점에서 ‘정지된 평형모형’으로대표되는 경로 의존성의 전형적 사례임을 확인할 수 있었다. 이는 경로진화 과정에서 제도의 경로운영자인 검찰이 법조계 등 독점적 정책옹호연합의 지원 및 기소독점권 유지라는 정책이해의 공유를기반으로 삼아 경로변화에 대한 외부적 장벽인 정치적 비토 가능성은 낮은 상태에서 높은 재량성을발휘한데 기인한 것으로 분석되었다. 앞으로의 검찰 개혁은 제도운영자인 검찰의 높은 수준의재량권을 견제하고 검찰 스스로가 지속가능한 개혁을 할 수 있는 공론의 장을 마련하는 등 지속적인개혁 과정을 통해 독점적 정책하위체계를 완화할 필요가 있다는 함의를 도출하였다.
Abstract
This study aims at analyzing the policy change on the central investigation bureau of theSupreme Prosecutor's Office in Korea. The paper draws attention to build up a new modelthrough the application of the path dependency and path evolution framework perspectives. The central investigation bureau of the Supreme Prosecutor's Office was introduced in Aprilof 1961, was abolished, and then changed to the new anti-corruption bureau in 2013. Thispaper argues that the central investigation function was introduced on the condition ofcontingency and critical junctures, but path revolution perspective was developed by theinfluence of external and internal factors. Path evolution was not a radical changing processfollowed by traditional path dependency theory, but a gradual policy changing process thatnew contents were partly added to an existing system.
