미술진흥법상 미술품재판매에 대한 작가보상금(“추급권”)은 미술품의 예술적 가치가 아닌 시장가치에 기초를 두고 있다. 미술품의 시장가치는 작가의 역량뿐만 아니라 갤러리, 경매회사, 평론가 등 전문적 미술시장 관계자와 소장가 및 공공기관의 기여도가 반영된다. 따라서 추급권 제도는 각 영역의 기여도를 최대한 반영하는 방식으로 설계되어야 제도의 합리적 운영을 꾀할 수 있고 미술시장의 혼란을 막을 수 있다. 이 글에서는 유럽의 해외 추급권 제도 운영 사례를 운영・관리 주체 선정 및 운영방식, 수수료 관리, 거래정보 수집 및 관리, 작가보상금 지급 대상 및 징수・지급 방식을 위주로 살펴보았다. 특히 선택적 집단관리 모델을 채택하고 있는 프랑스와 의무적 집단관리 모델을 채택하고 있는 스페인을 위주로 살펴보았다. 각국의 성공 또는 실패 사례들을 통하여 미술진흥법 시행령에 포함되어야 할 구체적인 문제지점을 파악하고 그에 대한 입법방향을 제안하였다. 관리방식에 있어서는 신고제 대신 참여를 장려할 수 있는 협약유도형/작가주도형 등록 모델을 제안하였고, 수수료에 있어서 다양한 미술시장 관여자의 기여도를 감안하여 미술진흥목적 기금 마련의 법적 근거를 마련할 필요가 있음을 강조하였다. 추급권 제도 초기 혼란을 방지하기 위하여 상속인의 추급권 행사권을 유예하고 추급권의 대상이 되는 미술품의 범위 설정에 대한 논의를 시작할 필요성을 제기하였다. 또한 추급권 제도가 사문화 또는 남소의 이유가 되는 상황을 방지하기 위하여 단계적 적용방안을 제안하였다.
Abstract
The artistic value of an artwork is shaped primarily by the artist’s aesthetic capabilities, whereas its market value reflects the contributions of a wide range of stakeholders, including galleries, auction houses, critics, collectors, and public institutions. A fair and balanced recognition of these contributions is essential for sustaning stable market valuations. Beginning in July 2027, Korea will become the first country in Asia to implement the artist’s resale royalty right, which has drawn considerable attention within the global art market. The resale royalty grants an artist a claim to a portion of the profits generated in secondary-market transactions, for the purpose of promoting artistic creation. However, given the diverse contributions of stakeholders, careful assessment is required of the scope and application of the resale right. This article reviewed the operational practices of countries that have already introduced such systems, including France, Germany, the U.K., and Spain. Particular attention is paid to the structure and role of managing bodies, the mechanisms for collecting and distributing resale royalty fees, and the system used to gather and manage transaction information. Based on this comparative analysis, this article proposes specific considerations that should inform the formulation of the presidential decree under the Art Promotion Act.
