Abstract
This Article notes the progress of the domestic legislation of the Artists’ Resale Right(Droit de Suite) and proposes considerations for sub-legislation by revealing potential legal issues to be discussed before it takes effect in four years. On June 30, 2023, the 「Art Promotion Act」 bill passed the plenary session of the National Assembly, introducing artist‘s resale right in Korea. Resale Right is the right to claim a part of the profit of resale arising after the first sale of an artwork. Resale right is reasonably interpreted as an author’s property right, and is compatible with the exhaustion theory. The provision is advisable to be incorporated into the Copyright Act in the future in light of its legal nature and overseas legislation. The payer of the resale compensation in Korea can be the buyer in cases with parties’ consent, given that in the case of SNA v. Christie’s France the resale right provision was interpreted as such albeit its mandatory nature. Furthermore, since Droit de Suite is contractually executed in the NFT art market, this article suggests its harmonious interpretation with statutory provisions of the Art Promotion Act. Opensea, the largest NFT artwork trading platform, has been applying a rate of 10% through smart contracts. However, with recent contraction of the NFT markets, various platforms including Opensea lowered or eliminated the resale rate to within 5%. Accordingly, now that the statutory resale right is introduced, we cannot rule out the possibility that the resale on NFT art works may also be subject to the statutory resale royalties, as discussed in France and the U.S. Lastly, in light of overseas cases and the rather fading market of NFT art transactions, the following should be considered in the sub-legislation of Art Promotion Act’s resale right. First of all, the subjects of application of the right should be determined in detail, including prints that can be copied, as in the Enforcement Decree of the French Copyright Act, and a unified interpretation of the definition provisions between the Art Promotion Act and the Copyright Act should be applied. Furthermore, the current period applied for resale rights under the Art Promotion Act is 30 years after death, but in light of overseas cases, there is a possibility of revising this up to 50 years or 70 years after death, which is the same as other intellectual property rights’ protection period. It would be more efficient to have a dedicated art promotion agency collect resale compensation than to have multiple agencies as is the current legislation, and general procedures and systems for compensation collection and payment should be established. Furthermore, it is worth considering raising the minimum selling price subject to the compensation, and there is a need to discuss whether to prepare penal provisions non-payment of resale compensation, but it is necessary to establish a remedies provision first, to improve the effectiveness of this new right.
