한국의 영토 - 국경문제 연구에 대한 시론(試論)

17세기 이전 한국은 북방에서는 중국과의 사이에 국경이 명확하지 않았고, 동쪽 섬들에 대해서는 소유가 다소 애매한 상태에 있었다. 1699년(숙종 25년) 일본과의 외교적 합의(울릉도쟁계합의)와 1712년(숙종 38년)에 건립된 백두산정계비를 통하여 압록강, 토문강(송화강 지류), 독도를 경계로 하는 영토가 확정되었다. 그러나 근대민족국가로의 이행과정에서 일본은 1905년 독도를 편입하고, 1909년 간도(현재 중국의 연변조선족자치주)의 영유권을 중국에 인정함으로써 조선의 영토적 통일성을 파괴하였다. 그 연장선상에서 조선은 식민지로 전락하면서 근대민족국가의 형성에 실패했다. 이처럼 간도문제와 독도문제는 발생과전개과정에서 매우 유사하다. 그럼에도 한국의 영토문제에서 이 두 가지는 같은레벨에서 논의되지 않고 있다. 백두산정계비는 국경조약이라는 관점에서 논의되고 있으나, 울릉도쟁계합의는 독도문제 연구에서 매우 소홀히 취급되고 있는것이다. 또 독도문제연구에서는 다음과 같은 문제제기가 가능하다. 울릉도쟁계합의는 울릉도 영유권만을 대상으로 하고 있는가. 울릉도쟁계합의가 독도 영유권을 포함하고 있다면, 한국의 독도연구에서는 왜 이 점을 부각시키지 않는가. 또 1905년의 일본의 독도편입을 비판하는데 있어서 이론적으로 논란이 있는무주지 선점의 부정 및 편입에 대한 통고의무 불이행 외에는 반박할 수 있는논리는 없는가.
Abstract
Before the 17th century, the border between the northern region of Korea and China was unclear, and the ownership of eastern islands was indefinite. Through the diplomatic agreement with Japan (Ulleungdo Jaenggye Agreement) in 1699 (25th year of King Sukjong's reign) and the Baekdusan National Boundary Monument built in 1712 (38th year of King Sukjong's reign), the territory was defined with its border formed by Amnok River (Yalu River), Tomun River (branch of the Songhua River), and Dokdo. However, in the process of transition into a modern nation-state, Japan incorporated Dokdo into its own territory in 1905 and admitted China’s claims to Gando in 1909, thereby destroying the territorial unity of Joseon. As an extension of that, Joseon degenerated into a colony and failed to form a modern nation-state. As such, the issues of Gando and Dokdo are very similar in terms of occurrence and development process. Nonetheless, these two are not discussed at the same level in the Korean territorial issue. While the Baekdusan National Boundary Monument is discussed in terms of border treaty, the Ulleungdo Janggye Agreement is neglected in the studies of the Dokdo issue. Moreover, the following questions can be raised in studying the Dokdo issue. Is the Ulleungdo Janggye Agreement only on the dominium of Ulleungdo? If the Ulleungdo Janggye Agreement includes the dominium of Dokdo, why is this not emphasized in the studies of Dokdo in Korea? Furthermore, isn’t there any other logic to criticize Japan's incorporation of Dokdo into its territory in 1905, aside from the issue of terra nullius occupation and nonperformance of the obligation to notify about incorporation, which raises theoretical controversies?.
