능동적 시민으로서의 군인 — 독일 군인법제를 중심으로 —

초록

2010년 군당국의 불온도서 지정에 대한 합헌결정을 통해 헌법재판소는 특별권력관계론을 사실상 공인하였다. 군대는 헌법재판소의 도움으로 ‘국가 속의 국가’로 또 입대하였다. 필자는 최근 일련의 사건들을 염두에 두면서 군인의 정치적 권리를 검토했다. 우리나라 군인은 정당이나 정치단체에 가입할 수 없다. 군인의 정치적 표현행위도 직무 관련성과 관계없이 엄격히 규제를 당하고 있다. 이러한 과도한 규제 방침은 시대적 흐름에 배치되며, 다른 나라와 비교할 때도 지나치게 엄격하다. 특히 정치적 중립 원칙은 진보적이고 비판적인 군인에게만 작동하는 수단으로 전락하였다. 군인의 정치적 권리를 일정한 범위 안에서 인정해야 할 시점에 이르렀다. 필자는 독일 국방헌법의 개혁관념으로서 ‘민주적․시민적 지휘’와 ‘제복 입은 시민’을 검토하고, 이러한 개념틀 속에서 독일 군인의 정치적 권리와 의무를 조망하였다. 독일은 나치 제국과 군대가 자행한 야만을 극복하는 방편으로서 군인의 능동적 시민성을 제도적으로 구현했다. 독일 군인법제는 군인에게 표현의 자유, 결사의 자유, 정당가입권 그리고 공직출마권까지 인정한다. 이러한 권리 인정은 군대에 민주적 법치주의를 관철시키는 역할을 아울러 수행한다. 유럽의 대다수 국가들도 차이는 있지만 군인의 정치적 권리를 다각도로 인정하고 있다. 군인의 인권 담론은 민주주의와 인류 평화에 기여해야 한다는 보편적 시민성의 책무를 포함한다. 이는 제복 입은 시민의 칸트적 맥락이다. 그런데 군인의 인권에 관한 우리 사회의 논의에서 군인의 정치적 주체성이나 보편적 시민성은 흐릿해지고, 부대시설의 소비자나 사생활의 주체로서 군인상만 부각되고 있다. 군인 인권법의 과제들이 산적해 있지만 학살과 인권침해에 대한 예방책으로서 법의 역할을 진지하게 고려해야 한다. 이러한 맥락에서 필자는 군인인권법을 국제인권법과 국제인도법의 중층지대라고 본다.

Abstract

This article aims at seeking a republican or pacifist understanding of the political status of the soldier as citizen inspired by Immanuel Kant. The principle of political neutrality of the military in the constitution of Korea has been treated as a guarantee for non-occurrence of political interventions and coup d'etat by the military. Therefore, the total ban on political activities of the military is undoubtedly accepted as one of the constitutive parts of the constitutional fundamental order. Korea has highly restrictive regulations on all civil or political rights, compared with the army legislations of foreign countries. Korean military laws do not acknowledge the freedom of expression, the freedom of association, the right to join a political party and the right to run for public elections. But this strict regulation is mainly being targeted at the politically critical or progressive soldiers. It is high time to take soldiers’ political rights seriously and to imagine the soldier as a politically active citizen. Alternatively, this essay introduces the post-bellum developments in the German military law system which makes the radical break with the dark traditions of the Nazi. Concerning soldiers’ political rights system, German military constitution adopts the least restrictive system for soldiers’ political activities. In principle, the freedom of expression, the freedom of association, the right to join a political party and the right to run for public elections are recognized as soldiers’ rights in Germany. This essay focuses on the formative context of the military law reform in Germany after the Second World War and addresses intensively the Innere Führung(leadership development and civic education) and Staatsbürger in Uniform(citizen in uniform) as crucial reform concepts. These concepts were designed to fulfill the various requirements of the international humanitarian law and human rights law and to overcome the fundamental criticisms by the pacifist civil society.
