Abstract
The Korean Truth and Reconciliation Commission established by the 2005 Act began to make decisions on cases involving the US soldiers among the ‘mass illegal victimization of civilians from August 15, 1945 to the Korean War period’. In finding the truth on the cases such as in Sanseong-dong, Yecheon and Wolmi-do beyond the Nogunri case for which action had been taken since 2000, the Commission stated that these cases were in violation of international humanitarian law on the protection of civilians, amounting to war crimes and giving rise to State responsibility of the United States. These decisions dealt directly with the issue of the application of law to the cases in the Korean War. In comparison with similar activities for clearing the past, this position marks a significant advancement in clearly indicating the guidelines on the scope of truth to be revealed and forming the starting point for discussion on the necessary and concrete steps to be taken for the resolution of these cases. This article deals with the question of application of international humanitarian law as a legal framework for the assessment of the US related cases. The application of international humanitarian law cannot be affected by the question of the nature of the Korean War involving the whole process which started from the small scale of military conflicts between the North and the South after the liberation of Korea from the Japanese rule, and developed into a total war since June 25, 1950 and the participation of the US and other States in the war. During the Korean War, it was difficult for the international treaties governing war related matters to be applied as such, yet customary international law should nonetheless be applied. Moreover, the warring parties at that time declared to apply de facto the minimum humanitarian provisions as reflected in the Geneva Conventions among others. The US, in particular, took the position to respect even to the civilians of South Korea the fundamental principles of international humanitarian law applicable irrespective of the character of armed conflict. In matters of the conduct of war by the US army, the principles of customary international law as contained in the Hague Convention IV and the Rules of Aerial Warfare were deemed to be applicable. The question of the application of international human rights has also been raised in relation to the acts during the Korean War such as the rights to life and to fair trial. There are human rights to be absolutely protected even in wartime, foreign troops being no exception to this obligation. The acts of the US forces should be evaluated in accordance with international human rights law as well as international humanitarian law. The resolution on the US related cases should be searched on the basis of the respect of the human rights of victims to reparation.
