이 연구의 목적은 특수체육 현장에서 인권침해가 발생하는 원인은 무엇이고, 인권친화적 특수체육 환경을 만들기 위해서는 어떤 요건들이 갖추어져야 하고, 어떤 노력이 요구되는지를 파악하는 데 있다. 이를 위해, 먼저 지난 10년 동안 특수체육 현장에서 인권침해로 인해 징역형이 선고된 사건에 대한 판결문을 분석함으로써 특수체육에서의 인권침해는 어떠한 양상으로 일어나고, 그것은 어떠한 법적 책임으로 이어지는지를 살펴보았다. 또한, 판례분석만으로는 인권침해 사건들의 구체적인 사실관계를 파악하기 어려운 부분을 보완하기 위해 특수체육 현장에서 직접 교육을 수행하고 있는 특수체육교사들을 대상으로 심층면담을 진행함으로써 특수체육에서 발생하는 인권침해의 구조적 문제를분석하고, 이를 개선하기 위한 실천적 방안을 탐색하였다. 특수체육에서 인권침해의 주요 원인으로는 법적 책임에 대한 특수체육 관계자들의 이해 부족, 장애학생 훈육 방법에 대한 잘못된 인식, 장애 특성에 대한 전문지식 부족과 미흡한 교수역량으로 나타났다. 이러한 문제점의 개선방안으로는 장애학생 권리 옹호에 관한 특수체육교사의 인식 변화, 특수체육교사의 자격 및 전문성 강화를 위한 체계적 교육프로그램 개발, 특수체육의 인권적 갈등 상황 해결에 직접적인 지원을 제공할 수 있는 전문기관의 확충이 도출되었다. 본 연구가 인권에 기반한 법의식 증진을 도모하고 특수체육 현장에 적합한 맞춤형 인권교육 프로그램 개발과 인권 증진을 위한 정책 마련의 기초적인 정보를 제공할 수있기를 기대한다.
Abstract
The purpose of this study is to identify the causes and solutions of human rights violations in adapted physical education. To this end, we first analyzed court decisions on human rights violations in adapted physical education to see how human rights violations occur and what legal responsibilities they lead to. Next, in-depth interviews were conducted with adapted physical education teachers to identify the structural issues of human rights violations in adapted physical education and to explore practical measures to improve them. The main causes of human rights violations were found to be a lack of understanding of legal responsibilities, a misunderstanding of how to discipline students with disabilities, a lack of expertise in disability characteristics, and insufficient teaching skills. The measures to improve these problems include changing the awareness of adapted physical education teachers regarding the advocacy of the rights of students with disabilities, developing educational programs to strengthen their expertise, and expanding the number of professional organisztions that can directly provide support and assistance in resolving human rights issues. It is hoped that this study will promote awareness of human rights-based laws and provide basic information for the development of human rights education program suitable for adapted physical education and the formulation of policies to promote human rights.
