Abstract
The division of the Korean Peninsula is not confined to political and economic aspects but also extends to the legal sphere, resulting in the long-term coexistence of distinct legal systems in South and North Korea. Legal integration is an essential task for minimizing legal uncertainty and establishing a coherent legal order in the process of Korean reunification. Given the geographical characteristics of the Korean Peninsula, which is surrounded by the sea on three sides, the maritime sector necessitates extensive international coordination and is regarded as a crucial factor in positioning a unified Korea as a maritime power. Accordingly, this paper identifies the current status and system of the maritime laws of the North and the South, and compares and analyzes individual laws in detail. By understanding the similarities and differences between the respective maritime legal systems, this paper reaffirms the necessity of legal integration. Furthermore, it reviews key considerations in the process of legal unification and outlines the fundamental framework for a harmonized maritime legal system. Based on this analysis, the study proposes a phased and structured approach to resolving the division of maritime laws and achieving legal integration as a fundamental step toward establishing a unified maritime legal system. The legal integration between South and North Korea plays a pivotal role in the process of national unification, and maritime law is no exception. Maritime law is inherently international in nature, making it more amenable to integration and coordination compared to other legal systems, thereby serving as a foundation for practical cooperation in the unification process. The integration of maritime law is expected to emerge as a key area of discussion in future inter-Korean exchanges and cooperation, potentially taking precedence over political and military cooperation.
