남북한의 재난·재해법제 비교 분석

이 연구는 남북한의 재해재난법제를 분석하여 그 체계와 현황을 알아본다. 이는 남북교류협력과 향후 통일과정에서 재난법제분야의 발전방안을 모색하기 위한 전제조건으로 적절한 연구라 할 수 있다. 그러나 북한 체제의 경직성 내지 비밀주의로 인해 북한 내 재해의 수준과 규모, 그리고 그에 대한 재난관리, 법률적 체계에 대해서는 북한의 통계나 자료공개가 거의 전무한 실정에서 그 실태를 파악하는 것은 불가능하다고 할 수 있으나 현재 북한의 재해 법령은 공표되어 있어 그에 대한 분석은 가능하다. 이를 위하여 우선 북한 재해법제의 내용을 살피고, 이에 입각한 재해관리 실체를 파악하여 남한의 재난법제와 비교하였다. 아울러 사회주의 종주국으로서, 북한정권의 수립에 결정적 역할을 하였던 중국의 재난법제 내용분석을 북한재해 법제의 내용상 그 연관성을 찾고자 한다. 북한의 재해관리에 대한 기본법으로서 『재해방지 및 구조, 복구법』을 분석하는 것은 북한의 재해법의 실태를 평가하는 데에 있어 사전적이고 기본적 연구에 해당하는 것으로, 동 법에 대한 분석은 북한의 재해관리제도와 실제를 파악할 수 있을 뿐만 아니라 재해에 대한 그들의 인식도 추정할 수 있을 것이다. 또한 남북한법령을 중심으로 한 법적 접근연구이되, 비교법적 접근을 시도한다. 그 하나는 남북한의 비교이며, 또 다른 하나는 북한과 중국의 법제비교를 통하여 그 시사점을 찾고자 한다. 결국 이러한 법제도적 접근분석은 남북한의 재난ㆍ재해통합을 위한 법제도적 방안을 도출하는 데에 그 초점을 맞추고 있는 것이다. 이러한 관점과 목적에서 북한의 재해법제에 대한 기초적 이해를 토대로 보다 범위를 넓혀 적용하여 나갈 때 보다 다양한 분야에서 효율적인 남북협력기반을 다져 나갈 수 있다. 바로 이 점에서 북한의 재해법제의 연구가 필요하고 이로부터 북한의 재해법제를 현장에 적용함에 있어 그 현실을 대비하는 작업이 가능하게 된다. 이는 남북의 재해재난법제의 비교를 통하여 양 제도의 현재를 파악하고, 그 차이에 기초하여 보다 합리적인 교류협력방안을 찾는 것은 물론 통합방안을 위한 대안을 마련하여 나아가는 데에 있어 기초적 자료로 활용할 수 있게 될 것이다. 남북한의 통일과 통합을 이야기 할 때 법제도적 통합을 예상하게 되고, 이는 현실문제로 다가선다. 재난관련분야에 있어서도 예외가 될 수 없다. 재난의 빈발성과 지역을 넘어서는 피해의 결과를 감안하면, 정치, 군사적 협력보다 재난과 재해 분야에서 향후 남북교류협력의 중요한 논의분야가 될 것이다.
Abstract
This study analyzes the disaster legislation and examines the system and current situation of the disaster laws in South and North Korea. This is an appropriate precondition for the development of the disaster related laws in inter-Korean exchange and cooperation and future unification process. However, it is impossible to grasp the level and scale of disasters in North Korea due to the rigidity or secrecy of the North Korean regime, and the actual situation of disaster management and legal system in the situation where there is almost no disclosure of statistics or data by North Korea. However, the current disaster laws and regulations of North Korea are publicized and analysis of them is possible. For this purpose, the content of the North Korean disaster legislation was examined, and the disaster management reality based on it was compared with the disaster law system of South Korea. In addition, I would like to find out the relevance of the content analysis of the disaster legislation in China, which has played a decisive role in establishing the North Korean regime as a suzerain of socialism. Analysis of the “Disaster Prevention and Restoration Act” as the basic law on disaster management in North Korea is a preliminary and basic study in assessing the actual condition of the disaster law in North Korea. In addition to being able to understand the disaster management system and its actual situation, it is possible to estimate their perception of disasters. It is also a legal approach study centered on the laws and regulations of North and South Korea. One is the comparison of the two Koreas, and the other is to find out the implications through comparison of the legal system between North Korea and China. In the end, this legal institutional approach focuses on deriving legal and institutional measures for the disaster and disaster integration of the two Koreas. Based on this basic understanding of North Korea's disaster legislation, it is possible to broaden the scope of North Korean disputes and to develop effective inter-Korean cooperation in various fields. In this regard, it is necessary to study the disaster legislation system of North Korea and from this, it becomes possible to prepare for the reality in applying the disaster law system of North Korea to the field. This can be used as a basic data to understand the current status of the two systems through comparison of disaster disaster legislation in the north and the south, to find a rational exchange and cooperation plan based on the difference, and to prepare alternatives for the integration plan When we talk about the unification and integration of the two Koreas, we expect to see legal institutional integration, which is a real problem. It can not be an exception in disaster related fields. Given the frequency of disasters and the consequences of damage beyond the region, it will be an important area of discussion for future inter-Korean exchanges and cooperation in disaster and disaster areas rather than political and military cooperation.
