Abstract

Does the free-will exist? Where does the free-will exist? The controversy around about the existence of free will that was triggered by the experiment of B. Libet posed a serious challenge to philosophy and law. The claim that the free will is merely an illusion by that my consciousness is simply informed of the unconscious brain response and that I seem to exercise conscious actions destroys the notion of philosophical responsibility and criminal punishment of law. But why do we experience the free will so vividly, even if we are not physically free from our brain reactions? I think there will be an answer when we distinguishes between the free- will and the social free will. There is no personal free-will, but there is social free- will. I can give up my personal free- will such as I can raise my hands freely, but there is clearly a sense of social free-will for accountability and punishment in the community. I would like to call this as the phenomenological life world(Lebenswelt). We live a life in which the subjective world, the objective world, and the mutually subjective life world coexist. Concepts such as human rights, peace, rights, business, and the nation that make up the living world do not exist physically, but they have a direct impact on physical and subjective life. If so, it can be argued that the free-will exists as a basic element that constitutes such a living world as a social element.
