Abstract
This study examines the structure and role of emotions in Confucian legal philosophy by comparing the theories of adjudication (刑政論) as developed by Jeongjo, Jeong Yak-yong, and Bak Ji-won in late Joseon. Whereas modern legal philosophy has tended to dismiss emotions as irrational and subjective, legal reasoning in this period recognized them as essential conditions for realizing justice. Jeongjo emphasized the “publicization” of emotions in addressing grievances, transforming personal resentment into moral sentiments that served as instruments of edification. Jeong Yak-yong sought the “objectification” of emotions by validating sentiments that conformed with common human feeling (常情), while maintaining the authority of legal standards. Bak Ji-won highlighted “resonance” (感應) with the concrete circumstances and emotions of litigants, making empathetic response a central criterion of fair judgment. These approaches illustrate how late Joseon legal thought transformed emotions from private impulses into the ethical foundation of communal justice. By analyzing the conditions under which emotions contribute to the legitimacy of public judgment, this paper demonstrates the relevance of Confucian legal philosophy for contemporary debates on the relationship between law and emotion.
