수산자원보호구역의 효과적 보호･관리를 위한 법적 검토 및 향후 과제

해양보호구역을 2030년까지 30%로 확대하자는 목소리가 국제사회에서 커지면서, 우리나라도 이런 추세에 맞춰 여러 국제회의에서 해양보호구역의 중요성을 언급하였다. 그러나 국내에서는 이미 지정된 해양보호구역을 해제하자는 요구가 제기되는 등 이를 역행하는 목소리도 존재한다. 수산자원보호구역은 연안의 간척･매립 및 연안어장 오염으로부터 수산자원을 보호･육성하기 위해 지정된 보호구역이지만, 해당 지역주민과 지자체는 이미 수산자원보호구역 내 심각한 오염과 서식지 훼손이 발생하여 보호구역의 해제를 요구하고 있다. 수산자원보호구역에서는 과도한 행위제한에 따른 민원이 오랫동안 제기되어 왔는데, 이러한 행위제한에도 불구하고 수산자원보호구역이 효과적으로 보호되지 못한 것이다. 육상에서 발생한 오염은 수면에 영향을 미치고 있고, 어업･양식 등으로 인해 발생한 오염도 보호구역 서식지 훼손과 생산량 저하에 영향을 미치지만 규제대상에 포함되지 않는다. 따라서, 본 논문은 수산자원보호구역의 지정･변경 및 행위제한 관련 규정의 내용과 문제점을 살펴보고, 효과적 보호･관리를 위해 개선방안 및 향후 과제를 제시하고자 한다.
Abstract
As many international forums have been emphasizing the extension of Marine Protected Areas (MPAs) to 30% by 2030, the Korean government has also mentioned the importance of the MPAs’ extension at several international meetings. However, some proposals to revoke designated MPAs have been strongly arising nationally in Korea. Even though the Marine Resources Protection Zones (MRPZs) were designated to protect marine resources from pollution caused by reclamation, landfill or fishing grounds, relevant local people and governments are asking for the revocation of the MRPZs because of serious pollution within the water, in addition to strong restriction on acts in the MRPZs. In other words, despite the strong restriction on acts, the MRPZs has not been adequately protected. While pollution generated from the adjacent land causes an adverse impact on the waters, activity of fishing and aquaculture, found to disturb fish resources and habitats, is not regulated properly. Therefore, this study looks over related laws and regulations on designation and revocation of the MRPZs and its restriction on acts. Based on that, it suggests improvements and future tasks to effectively protect and manage the MRPZs.
