해양생태계에 관한 국제규범의 변화와 우리나라 법제의 통합 방안

초록

해양생태계 관련 국제해양규범은 상업성 있는 일부 어족의 이용을 중심으로 하고 있어, 생물다양성과 생태계를 충분히 고려하지 못한다고 평가받는다. 비록 점차 그 보호대상의 범위를 확대하고 있으나, 근본적으로 ‘일부 어족’의 ‘이용’을 중심으로 하는 구조를 극복하지 못하고 있다. 이로 인해 해양생태계 그 자체뿐만 아니라 일부 어족의 지속가능성까지 위협하고 있는 실정이다. 국제사회는 이러한 해양거버넌스가 가지는 한계를 인식하고 이를 극복하고자 협력/통합의 접근법을 통해 해양생태계의 보전과 지속가능한 이용에 관한 해양 패러다임 전환을 위해 노력을 하고 있다. 우리나라는 유엔해양법협약에 따라 해양 영역의 종합적 관리를 위해 일찍부터 해양 법제와 행정을 통합하였다. 그러나 그 과정에서 국가 생태계 법제 영역에서 ‘해양생태계’는 분리되었다. 그리고 해양 법제 내에서 해양생물자원의 이용 측면이 해양생태계 보전 측면보다 강조되어 온 반면, ‘이용’과 ‘보전’, 즉, ‘해양생태계’와 ‘수산’ 영역은 서로 협력을 이루지 못하였다고 보인다. 본 논문은 해양생태계 보전과 관련하여 국제해양규범이 가지는 한계와 우리나라 법제의 한계를 검토하고, 해양생태계 보전 영역에서 기존 해양거버넌스가 가지는 한계를 극복하기 위해 협력의 접근법에 주목하였다. 또한 국제사회에서 수행되고 있는 여러 협력의 방법을 바탕으로, 그 동안 우리나라의 해양생태계 영역에서 이루어진 ‘통합’의 한계를 극복할 수 있는 방안을 찾아보고자 하였다. 그리고 법제도적 과제로서 국가 생물다양성 법제의 통합(협력), 해양법제 내에서 해양생태계 영역과 수산 영역과의 통합(협력)을 제시하고, 구체적인 개선안을 마련해보았다.

Abstract

International legal instruments on marine living resources are focusing on commercially viable specific fish stocks, while overlooking entire marine biodiversity and ecosystem conservation. Even though it has tried to extend the scope of protected subject to the ecosystem, fundamentally it does not transform a basic structure that is the specific fish stocks-centered, and use-centered marine governance. However, this approach can threaten not only marine ecosystem itself but also sustainability of the specific fish stocks. In this regard, international society recognized limitations of the current marine governance, and has tried to revise the marine paradigm through a new approach of ‘cooperation’ and ‘integration’ to conserve marine ecosystem and its sustainable use in a comprehensive way. Actually, the Korean government has integrated marine-related legislations and its administration to comprehensively manage diverse marine-related fields in accordance with the UNCLOS very early in 1996. However, in the process of the integration, marine ecosystem has been diverged from national ecosystem legislation. In addition, within the marine-related legislations, the use of marine living resources has been emphasized over the conservation of marine ecosystem, while ‘use’ and ‘conservation’, or ‘ecosystem’ and ‘fisheries’ have not been integrated. Therefore, this study reviews the limitations of the international legal instruments on the marine ecosystem and its relevant legislations in Korea. And it concentrates on the cooperation as the new approach to overcome the limitations of the current marine governance on the conservation of marine ecosystem. Based on diverse cooperative methods conducted in the international society, it tries to find out the ways to overcome the limitation of the current marine-related legislations in Korea which has been caused in the process of integration. Finally, as for legal and institutional tasks, it suggests an integration (or cooperation) of national biodiversity-related legislations, and an integration (or cooperation) between marine ecosystem and fisheries within marine legislations. In addition, it also suggests specific amendment of the relevant legislations.
