이 연구는 국가윤리와 국가권력의 문제를 자연법의 입장에서 다루어보는 데 그 중요한 목적을 둔다. 자연법에서 지향하는 국가윤리는 인간의 존엄성과 사회적 차원의 공동선을 동시에 달성하려 한다. 가톨릭은 자연법에 토대한 국가론을 견지하여 인간화를 보장할 수 있는 보다 완전한 사회윤리를 정립하고자 한다. 먼저, 가톨릭에서 바라보는 국가윤리의 근원과 정당화를 둘러싼 제반 논의를 알아봄으로써 국가론의 토대와 전제를 다룬다. 다음으로, 국가권력의 원천을 어디서 어떻게 찾아야 할 것이며, 그리고 다양한 국가형태와 그 올바른 권한행사 방법에 대해서도 살펴본다. 마지막으로, 가톨릭의 입장에서 바라본 국가권력의 한계와 효력범위 및 국민의 저항권 등에 대해서도 검토한다. 이런 논의를 통해 국가와 국가권력에 작용하는 자연법적 근거를 밝혀보며, 아울러 인간존엄성에 부합하는 국가윤리와 국가권력의 문제를 타진한다.
Abstract
In this paper, we deal with the problems about national ethics and national power from the viewpoint of natural law. The Catholicism observes the State in the perspective of the natural law which could guarantee the human dignity and common good. The national ethics which is based on a natural law provides the ground which can complete the fundamental premise of social ethics. First, we examine the base and prerequisite of theory of the State considering the origin and justification of the national ethics in the aspect of Catholicism. And wrequexamine the beginning, source and character of national power and als wthe vacanus forms of national power and its proper exercise method. We try t wratiew about the lsitt, effect scope and res abahee circle of national power from position of Catholicism. Finally, through this trial, we are trying to widen the area of recognition about natural law in oder to see the nation and nation power rightly. Also we are trying to realize the human dignity establishing the relationship of balance and harmony between citizen and national power.
