입법자 없는 성 토마스의 자연법은 가능한가?

우리가 성 토마스의 자연법 교설을 연구함에 있어서 그의 자연법 교설과 그의 교설에 아주 지대한 영향을 주었다고 볼 수 있는 아리스토텔레스의 도덕 교설과의 관계를 검토해보는 것은 필수적이다. 그리하여 본 연구자는 양자 사이의 관계에 대한 두 가지의 평가를 중심으로 연구해보려고 한다. 첫째, 본 연구자는 제이퍼의 주장, 즉 성 토마스의 자연법 안에 있는 법적인 성격이 하나의 신적인 입법자와 입법, 그리고 입법자의 의지와 명령들을 함유하고 있으므로 그의 자연법은 아리스토텔레스의 도덕 교설과는 전혀 다른 그리스도교적인 성격을 가지고 있다는 주장을 살펴볼 것이다. 둘째, 본 연구자는 어윈과 스톤의 주장, 즉 성 토마스의 자연법 교설이 신적인 입법자와 입법, 그리고 입법자의 의지와 명령들 없이도 가능하기 때문에 그의 자연법은 그리스도교적인 성격을 가지지 않고도 충분히 아리스토텔레스적일 수 있다는 단언을 통하여 제이퍼의 주장에 대한 반론을 제기할 것이다. 이러한 과정에서, 본 연구자는 신적인 입법자와 입법에 대한 반론의 근거로서 이성적 원리로서 자연법, 자명과 사고의 훈련법으로서 자연법, 이성 공동체와 자연법 등을 제시할 것이다. 이어서 본 연구자는 입법자의 의지와 명령들에 대한 반론의 근거로서 사물들의 객관적인 속성들에 대한 사실로서 자연법, 훌륭함으로서 자연법 등을 제시할 것이다. 그리고 나서 마지막으로 갈 주니어의 아리스토텔레스의 목적론적 인식론의 관점으로서 자연법이라는 논의들을 중심으로 해서 본 연구자는 비록 성 토마스의 영원법과 자연법에 관한 논의 과정에서 비록 신적인 입법자와 입법을 설정할 수밖에 없다 할지라도, 제이퍼의 주장과는 달리 그리스도교적인 신학에 의존하지 않고서도 아리스토텔레스적인 설명이 가능하다고 결론지을 것이다.
Abstract
When we make a study of St. Thomas natural law, It is essential for us to examine the relations his natural law with Aristotle’s moral teaching which has an very great influence upon his teaching. So I am going to make researches revolving around the two estimations of relationship between both sides. First, I will make observation of Jaffa’s contention, that is, the contention that because a legalistic feature in St. Thomas’ natural law contains not only a divine legislator and his legislation but also legislator’s will and his command, his natural law has the Chiristian character which is very different from Aristotle’s moral teaching. Second, I will carry on counterargument revolving around Irwin and Stone’s allegation, that is, the allegation that because St. Thomas’ natural law is possible without not only divine legislator and his legislation but also legislator’s will and his command, his natural law is able to be Aristotelian in its fullness. In this process, by way of foundations of a polemic against St. Jaffa’s allegation on divine legislation and legislation, I will come up with natural law as a rational principle, natural law as self-evidence and natural law as the disciplines of thought, reason community and natural law. After that, by way of foundations of a polemic against Jaffa’s allegation on legislator’s will and his commands, I will bring up natural law as the fact on the objective property of things and natural law as the fineness. And then lastly, Revolving around natural law by way of a viewpoint of teleological epistemology of Robert R. Gahl, Jr., I conclude that in the course of an argument on St. Thomas’ eternal law and his natural law, though we can not but set up the divine legislator and legislation, as distinct from Jaffa’s assertion, Aristotelian explanation is possible without depending on Christian theology.
