본 연구는 국가의 법에 복종해야 할 일반적인 직견적 의무, 즉 정치적 의무의 정당화를 위한 다양한 이론들 중에서 공정성론에 주목하고자 한다. 공정성론은 동의론에 대한 가장 체계적이고 설득력 있는 대안임에도 현행 도덕과 교육과정 및 교과서에서 제대로 다루어지지 않고 있다. 공정성론은 혜택론과는 구분되는 이론으로서 혜택론의 한계를 극복하면서도 독자적인 이론적 내용을 갖는다. 따라서 본 연구에서는 교육과정과 교과서에서 혜택론 대신에 공정성론을 다루거나 혜택론과 함께 공정성론을 다루어야 한다는 것을 제안한다. 또한 본 연구는 제한 논변이나 정당화 간극 같은 이론적 문제들이 해결 가능하다는 전제 아래, 공정성론이 갖는 도덕교육적 함의에도 주목하고자 한다. 공정성론의 밑바탕에는 국가를 공정한 협력 체계로 규정하는 관점이 깔려있다. 이러한 국가관 아래 공정성론은 우리가 정치적 의무를 중앙 권위나 법 자체가 아니라 협력적인 동료 시민들에게 빚지고 있다고 주장한다. 따라서 공정성론은 권위주의적인 이론이 아니다. 공정성론에 따르면 시민들이 국가를 공정한 협력 체계로 인식하여 확고한 의무의식을 가질수록 국가 전체의 시민적 덕성이 증대된다. 오늘날 다양한 갈등이 사회 문제로 대두되고 있는 한국 사회의 현실은 공정성론에 대한 도덕교육을 요청하고 있다.
Abstract
This study focuses on ‘fairness theory’ of political obligation among the theories to justify political obligation, i.e., a general prima facie moral duty to obey the law. Being the most systematic and plausible alternative theory to consent theory, fairness theory is not being treated fairly by the current moral subject curriculum and text books. We must recognize that fairness theory has sui generis theoretical grounds which help to overcome the serious problems and limits of simple benefit theory. So, this study suggests that we have to teach fairness theory instead of benefit theory or teach fairness theory with benefit theory by revising the curriculum and text books. Also, this study pays much attention to moral educational implication of fairness theory, on condition that we can solve the problems concerning ‘the limiting argument’ and ‘the justificatory gap’. We should take the conception of the state as ‘fair cooperative system’ underlying fairness theory seriously. Under the conception, fairness theory argues that we owe political obligations to fellow cooperative citizens not to the central authority or the law itself. Thus, fairness theory is not authoritarian theory. According to fairness theory, the more citizens recognize the state as fair cooperative venture, the more likely we can find civic virtue in our republic. This study concludes that today’s circumstances of Korean society characterized by various forms of conflicts and disputes require moral education of fairness theory.
