J. 게이로 대표되는 신학적 공리주의와 J. 벤담으로 대표되는 세속적 공리주의는 쾌락 공리주의라는 공통점을 지닌다. 쾌락주의가 지배적 이기주의 성향을 지니는 데 반해, 공리의 원리는 공평성에 기초해서 일반 이익 추구를 명한다. 그렇기 때문에 쾌락 공리주의는 공리의 원리를 따라야 할 동기와 이유를 적절히 제시하지 못하는 문제, 즉 동기화 문제와 도덕 정당화 문제에 직면한다. 이런 문제를 해결하기 위해 두 공리주의는 제재에 호소한다. 게이는 신의 제재를, 벤담은 외적 제재를 주장한다. 이들은 제재를 통해 공리와 자기 이익의 일치 가능성을 높임으로써 공리를 따를 동기와 이유를 제공하고자 한다. 이처럼 쾌락 공리주의에서 제재는 공리의 원리를 따를 자기 이익적 동기와 이유를 강화하는 장치로 기능한다. 제재는 쾌락 공리주의의 이론적 정합성의 핵심이자 공리의 원리를 따를 이유와 동기의 원천이다. 그러나 신의 제재나 외적 제재만으로는 동기화 및 도덕 정당화 문제의 해결에 한계가 있다. 두 문제의 해결을 위해서는 신의 제재나 외적 제재를 넘어서는 제재 이론이 요구된다.
Abstract
The theological utilitarianism represented by J. Gay and the secular utilitarianism represented by J. Bentham both have in common that they are hedonistic utilitarianism. While hedonism has a predominant egoistic tendency, the principle of utility dictates the pursuit of general interests based on the requirement of impartiality. For this reason, hedonistic utilitarianism faces the problem of failing to adequately provide motives and reasons for following the principle of utility, namely, the problem of motivation and the problem of justification for morality. To solve these problems, two sorts of utilitarianism appeal to sanctions. Gays insist on divine sanctions, while Bentham insists on four external sanctions. They try to provide motivation and reasons to follow the principle of utility by increasing the likelihood that general interests and self-interest will coincide through sanctions. As such, in hedonism utilitarianism, sanctions function as a device to reinforce self-interested motives and reasons to follow the principle of utility. Sanctions are the core of the theoretical coherence of hedonistic utilitarianism and the source of reasons and motivations to follow the principles of utility. However, there are limits to solving two problems, that is, motivation problem and justification problem for morality only with divine sanctions or external sanctions. To solve the two problems, a theory of sanctions that goes beyond divine sanctions or external sanctions is required.
