흔히 공리주의는 공익 추구를 근거로 사익 추구의 과도한 희생을 정당화하는 방식으로 양자의 추구들 사이의 갈등을 봉합하려 한다는 비판적 견해가 있다. 이러한 비판적 견해는 다시 공리주의자들이 그 갈등의 이론적･실천적 심각성을 제대로 인식하지 못했다는 해석과도 연결된다. 이러한 해석의 맥락에서 라이온스(D. Lyons)는 벤담(J. Bentham)이 사익 추구와 공익 추구 사이의 ‘자연적 조화’를 상정했다고 주장한다. 또 할레비(É. Halèvy)는 벤담이 법이론에서는 양자의 추구들 사이의 ‘인위적 조화’를 정부의 기본 기능으로 설정한 반면에 경제이론에서 그것들 사이의 ‘자연적 조화’를 가정함으로써 비일관적인 태도를 보여준다고 주장한다. 그러나 본 논문에서 필자는 라이온스와 할레비의 해석을 비판적으로 검토하고 오늘날의 일반적 해석에 조응하여 벤담은 어느 문제영역에서도 사익 추구와 공익 추구 사이의 ‘자연적 조화’를 상정하지 않았으며, 그의 모든 학문적･실천적 노력이 양자의 추구들 사이의 ‘인위적 조화’를 지향했다는 사실을 조명할 것이다. 이러한 조명을 위하여, 필자는 벤담이 정치･경제･사법 등의 공적 영역에서 추구한 ‘인위적 조화’의 양상을 살펴보는 동시에, 그의 ‘사적 윤리’ 혹은 ‘사적 의무론’이 이러한 인위적 조화에서 어떤 역할을 담당하는지를 살펴볼 것이다.
Abstract
There has long been a critical view that utilitarianism in general stitches up the vast hole between the pursuits of personal and public interests in the way that it justifies excessive sacrifices of the former for promoting the latter pursuit. This view is closely connected to once popular but now more or less outdated an interpretation that classical utilitarians did not sufficiently recognize the theoretical and practical weight of that hole. In this context, for example, D. Lyons asserts that J. Bentham assumed some contingent or ‘natural harmony’ between the pursuits of personal and public interests; É. Halèvy points out that Bentham exhibited an inconsistent position on that matter by laying down the artificial harmonization of those pursuits as the primary function of government in his legal and political theory and at the same time assuming some groundless ‘natural harmony’ in his economic theory. In this paper, however, I shall attempt to make it clear through a critical examination of the interpretations of Lyons and Halèvy that Bentham did not assume a natural harmony of those pursuits in any area of discussion, and that all of his academic and practical efforts converged on the artificial harmonization of those pursuits. In this attempt, I shall illustrate some aspects of the ‘artificial harmony’ sought by Bentham in such public areas as politics, economics, and law, and then consider the question of what role his ‘private ethics’ or ‘private deontology’ played in this harmonization.
