벤담의 공리주의는 결과주의, 쾌락주의, 공평성의 원리(보편주의), 총합주의, 그리고 제재 이론이 결합된 윤리 이론으로서 ‘공리의 원리’를 도덕의 제일원리로 제시하였다. 공리의 원리는 최대 다수의 최대 행복을 가져오느냐 그렇지 않냐에 따라 모든행동과 정책을 시인하거나 부인하는 원리이다. 이 공리의 원리를 따르도록 만들기 위해 벤담은 자연적, 정치적, 대중적, 종교적 제재를 사용할 것을 주장하였다. 벤담은공리의 원리를 근거로 사회의 공리를 극대화하지 않는 모든 제도와 법률과 도덕에 대한 근본적 개혁을 촉구하는 철학적 급진주의를 내세웠다. 그래서 그는 교회와 국가의분리, 노예제와 사형의 폐지, 범죄자와 동물을 잔인한 처우로부터 보호하기 위한 법적 규정, 동성애의 비범죄화와 같은 문제를 옹호하였다. 벤담의 공리주의는 쾌락주의에 대한 경험 기계 반론, 인간 이해의 편협함, 제재 이론의 한계, 역직관적 결론의 산출 등으로 비판받아 왔다. 하지만 벤담의 공리주의는 도덕의 과학화와 결과주의 윤리이론의 체계화에 공헌하였을 뿐만 아니라, 인종차별, 성차별, 종차별에 반대하는 도덕개혁주의를 선도하였으며, 도덕적 고려 범위를 시·공간적으로 확장하는 도덕 확장주의를 통해 인류의 집단적인 도덕적 진보에 기여하였다.
Abstract
Bentham's utilitarianism is an ethical theory that combines consequentialism, hedonism, the principle of impartiality, aggregationism, and sanction theory, and presents the 'principle of utility' as the first principle of morality. The principle of utility is a principle that approves or disapproves of all actions and policies according to whether or not they bring the greatest happiness of the greatest number. Bentham advocated the use of physical, political, popular, and religious sanctions to make us conform to the principle of utility. Bentham advocated philosophical radicalism that called for fundamental reform of all systems, laws, and morals that did not maximize the utility of society. So he advocated issues such as the separation of church and state, the abolition of slavery and the death penalty, legal provisions to protect criminals and animals from cruel treatment, and the decriminalization of homosexuality. Bentham's utilitarianism has been criticized for empirical machine objection to hedonism, the narrow understanding of human beings, the limitations of sanction theory, and the counter-intuitive conclusions. However, Bentham's utilitarianism not only contributed to the scientification of morality and the systematization of consequentialist ethical theories, but also led the moral reformist movement that opposed racism, sexism, and speciesism. Furthermore, by asserting moral expansionism which requires that the scope of moral consideration be expanded in time and space, it contributed to the collective moral progress of mankind.
