이 논문은 국회의원 윤리심사와 겸직제한 등의 자문을 위해 외부 인사들로 구성되어 설치된 윤리심사자문위원회의 제도적 한계와 행태적 문제를 분석하고 개선방안을 제안하는 것을 목적으로 한다. 분석결과, 본 연구는 자문위의 기능 확대 개편을 비롯하여 다음과 같은 윤리특위 관련 제도개선방안을 제안 한다: 징계요구권자의 범위 및 징계요구 시한 확대; 징계대상 행위의 구체화 및 공개로 위반 시 자동징계절차 개시; 자문의견에 대한 윤리특위의 징계의결 시한 도입 및 기간 도래 시 본회의 자동 상정 조항 신설; 윤리특위 위원장 및 위원의 지위 격상; 징계종류의 다양화 및 징계 시 불이익 확대; 공익목적의 명예직의 구체적 내용을 규칙에 규정; 겸직 신고 의무화 및 불성실 신고에 대한 대응방안 강구; 겸직불가 통보 시 사직 후 의장에 보고 의무화; 구체적이고 상세한 의원윤리매뉴얼 발간.
Abstract
Main purpose of this paper is to find out institutional alternatives to improve the ethical level of the National Assemblymen in Korea. Although the National Assembly had created a Special Committee on Ethics in 1991 and an Advisory Committee within in 2010, the ethical level has not been improved much. This paper proposes seven institutional improvements to make the Advisory Committee effective through the author’s actual experiences of being a member of the Advisory Committee for more than three years. Seven improvements include following: expansion of the scope and time limits of those who can demand disciplinary measures; list up detailed actions that may incur disciplinary actions; institutionalize automatic procedures by opening the due process and measures; apply time limits to be processed by the Special Committee on Ethics; diversify disciplinary measures and expand disadvantages; level up the quality and eligibility for the membership of the Special Committee on Ethics; and clarify meaning and scope of the term ‘honorary position and the purpose of public interests.
