정보화법제 정비를 위한 입법역량 제고방안의 역할

정보화는 사회구조와 생활양식의 근본적 변화를 야기하고 있다. 그래서 산업사회에 기반을 둔 기존 법제와 이론에 대한 변화를 요구한다. 이른바 디지털, 정보, 지식, 네트워크 등 정보시대의 핵심적 징표에 의한 사회적 적용과 확산에 따라 기존의 법제와 이론으로 설명하기 어려운 새로운 현상을 초래하면서 행정부차원을 넘어 범국가적 수준에서 입법적 대응을 필요로 한다. 하지만 현재의 국회의 정당기능은 입법역량이 제약되어 있다. 본 연구는 정보화법제를 둘러싼 환경변화를 뒤돌아보고 현행 정보화법제 실태와 문제점, 그리고 이슈를 진단하고 창조경제시대에 부응한 정보화법제의 방향에 대해 고찰하고자 한다. 창조성 중심의 사회변화 및 창조패러다임 전환과정에서 부상하고 있는 창조경제 구현 및 경제 재도약의 기틀 마련을 위한 입법적 대응으로서 바람직한 정보화법제 정비를 위한 입법역량 강화방안을 도출하고자 한다.
Abstract
Korean has leaded Information Society since Framework Act on Informatization Promotion had been promulgated in 1995. Korea has come to achieve the world’s best IT and is drawing global attention as a benchmark target. Law has two major roles regarding IT. Legal system is a mirror of a society. Therefore, it is imperative to conduct a study on the recent trend of legislations relating to IT in Korea. This paper will help us understand where we were and where we are, and predict what the future of the information society will look like. This study covers IT related legislations. In Korea, There have been a lot of legislations regarding all part of Information Society along with amendments in laws and systems to cope with the problems arising out of the development of the information society. Particularly, information policy issues has been p ouring d own and most o f informatization legislation is subjected to ‘sharing about public administrative information’ Besides, There have been a lot of discussions and legislations regarding ‘Laying industrial foundation for Information and Communications’ for adopting new creativity based economy and society rapidly.
