입법영향분석제도 및 사례 분석을 통한 새로운 방법론 구상

입법은 국민의 삶과 국가 정책에 지대한 영향을 끼친다. 특히 국민의 권리를 제한하고 의무를 부과하는 법률의 제･개정은 국민의 경제･사회적 생활 전반을 크게 변화시킬 수 있다. 입법영향분석은 법률안이 시행될 경우 미치게 될 전반적인 영향을 사전에 과학적･전문적･체계적으로 분석하여 입법자에게 제공함으로써 입법권의 실질적 행사와 법안 심사를 지원하는 도구이다. 입법이 과학적･전문적인 분석을 기반으로 할 때 비로소 입법의 정당성과 국회에 대한 신뢰도가 높아질 수 있고, 입법부의 행정부 견제 기능도 강화될 수 있다. 국회 내 입법영향분석의 필요성과 도입 방안에 대해서는 일정 부분 공감대가 형성되어 있고 제도화를 위한 논의가 진행 중이다. 우리의 입법 현실과 입법체계에 맞는 입법영향분석의 제도를 설계하고 적합한 방법론을 제시하는 것은 결코 쉬운 일이 아니다. 특히 입법에 대한 국민들의 높은 관심, 다양한 의제를 담고 있는 수많은 법률안, 역동적인 정치 여건 변화 등의 입법환경 속에서 적시에 입법영향분석이 실시되도록 제도를 설계하고 시스템을 구축하는 것은 매우 어렵다. 현재 국회입법조사처가 추진하고 있는 입법영향분석은 기본적으로 보편성, 포괄성, 효율성, 신속성을 지향하되, 우리의 입법환경 및 실현 가능성 등을 고려해야 한다. 따라서 분석 대상, 항목, 방법, 절차, 분석 조직 및 인력의 설계와 시행 등은 좀 더 유연하게 접근할 필요가 있다.
Abstract
Legislation has a significant impact on people's lives and national policies. In particular, regulatory bills that limit citizens' rights and impose obligations can significantly change the overall economic and social life of citizens. Legislative impact analysis is a scientific, professional, and systematic analysis in advance of the impact that may occur when a bill is implemented. This system provides analysis to legislators to support the practical exercise of legislative power and bill review. Only when legislation is based on scientific and professional analysis can the legitimacy of legislation and trust in the National Assembly increase. Additionally, the National Assembly's function of checking the executive branch can be strengthened. There is some consensus on the necessity and introduction of legislative impact analysis within the National Assembly, and discussions are underway for institutionalization. Designing a legislative impact analysis system that fits our legislative system and reality and finding an appropriate methodology is not an easy task. In particular, we are in a legislative environment with high public interest in legislation, many complex bills, and dynamic changes in political conditions. In this environment, it is difficult to design a system and build a system to conduct timely and high-quality legislative impact analysis. Our legislative impact analysis basically aims for universality, comprehensiveness, efficiency, and speed. However, our legislative environment and feasibility must be taken into consideration. Therefore, the design and implementation of analysis objects, items, methods, procedures, analysis organization and personnel, etc. need to be approached more flexibly.
